file I-129 F form while spouse is in the US on b2 visa

I am a swede who am right now in america to visit my girlfriend on a 6 months b2 visa.

I have during my stay decided to propose to my girlfriend who is an american citizen.

My girlfriend is enrolled in medical school here in the US so I would be the one moving.

I have no intent to stay in the US illegally and after searching on the internet it seems like the best way to go is to apply for a K1-visa.

I´ve understood that the application process time usually takes some were between 5-8 months and that the second "step" requires me returning home to Sweden for interview etc.

However the first step having my girlfriend filing a I-129F form does´nt seem to require me to be back home in Sweden.

my question is now, is it possible for my girlfriend to start the K1-application process while I´m still in the US on a valid b2 visa?

I´ve heard that it takes USCIS up to 6 months to file the I-129F and I would really like to spend as much time with my girlfriend as possible before returning home.

It is definitely possible for you guys to send in the I-129F while you are still in the USA, but as to the length of time that you can stay I am not sure.

July 01, 2019 (Day 327) : Oath Ceremony I AM NOW A US CITIZEN!!!!
