I wanted to ask about this specific interview requirement. According to the requirements in section "n""You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) ...."

- Others here who ask to confirm they have what they need list multiple past years of their tax return. However, requirement sates "most recent". Juts curious.

- Use the terms "Tax Transcripts" rather than 1040. I've seen this many times Is it not as simple as printing and singing my Turbo Tax 1040?

Anybody can falsify a 1040. They need something direct from the IRS. Either an ordered tax transcript (which is free by the way, and if ordered online can be in your hands in 10 days), or a 1040 WITH W-2s backing up the numbers.

The most recent tax return is the only one required. Multiple years of tax returns (3 years) was a requirement... key word... WAS. Why it still persists today? Paranoia!

The 1040 is what is requested by USEM, but the tax transcript is totally acceptable.

To make the embassy happy you can just hit print on your turbo tax to print out the 1040 tax return, attach a copy of your W-2 and all is good.

I have the W-2's to go with my Turbo Tax printout and I was going to sign it. BUT if I can simply request something via the IRS website, that seems pretty painless.

I just need 2012 right?

Strongly suggest you order the tax transcript (free) and submit that as support. This way you completely avoid running the risk the 1040 is bounced back. If you do submit a 1040 (I had to submit this because I filed paper..and that because I applied for and received a TIN for my Vietnamese spouse) you should include W2s, 1099s, etc. I submitted at least six lpieces of paper to support my AGI to cover wages, capital gains, and dividend income. Wages were more than enough but I was concerned about an RFE if I didn't provide support for every income item. Sending in a tax transcript avoids all of that mess.

Last 3 returns is required for the AOS, so that's why many just order the backlog.

Don't forget the USEM wants TWO copies of this, along with two of the employment letter, stubs, and whatever else you submit with the affidavit of support.

The Embassy Instructions Letter for the Philippines clearly states they want the most recent tax return (1040), they will accept the tax transcript but it is not needed in Manila.

What is done at the embassy in Vietnam is not universal, nor applies at the embassy in the Philippines.

Yes, you are correct about the U.S. Embassy Manila's requirements as stated in their K-1 "instructions" letter. They want you to submit your 2012 1040 and W-2. You should also submit some current paycheck stubs as proof of your current sustained income. Also, an employer's letter is sometimes asked for.

The Embassy should readily accept your 2012 tax transcript in place of your 1040 and W-2. However, there have been isolated cases over the years where the Embassy has required a 1040 and a W-2 to be submitted even though a tax transcript was submitted. If you want to play it safe, have your 1040 and W-2 available as a back up.

That is not true either! Lots of BAD information here.

AOS only required the most recent tax return also, a tax transcript is not required there either, but they will accept them.

I'm bringing both, as well as the previous 3 years'. So whatever they ask for, we'll have it.

You can bring all that makes you happy, but the CO at USEM will only take the most recent tax return and/or tax transcript. The other years you bring you will also be bringing back with you.

That is not true either! Lots of BAD information here.

AOS only required the most recent tax return also, a tax transcript is not required there either, but they will accept them.

Others have told me that they needed the 3 most recent for AOS. Did this change?

And Instructions for I-134 says to submit these items in "duplicate'.

The I-134 states a tax return is only required if you are SELF EMPLOYED.

Follow the Embassy instructions letter as it is where the tax return requirement applies to ALL, not just self employed
