I came into the USA on F 1 Visa in 2011 to start my Master’s Degree but I have known my spouse since 2007 when we were both in college in my country, he left for the US in 2007 on permanent residency and we continued dating till we met again in 2011. I graduated in May 2013 and currently working on OPT. We got married July 2013, he is now a US Citizen and we have submitted both forms I-130 and I-485 but my worries now is that we gave evidence of starting our relationship since 2007 showing all of our letters and emails exchanged when I was still in my country ( wanted to be very honest). I still have a valid visa till November 2014 and my work authorization is also valid.

Can anyone tell me I will not be charged with visa fraud that I only came to the US because he was here and not just to study. Please advise as well. Thank you.

It's not a problem as long as you didn't lie about having a bf in the US when you got your student visa. Did you hide the truth at that point?

I don't think there is any problem... You'll just need to go back to your country for the interview when your petition is approved...

August 29, 2013 POE - JFK

Yeah they don't ask about boyfriends, friends, or girlfriends during student visa interviews or at the POE. Only relatives and their status in the US.

Sometimes they ask in the interview, though.

I don't think you have to leave the U.S to adjust status.You would simply AOS with your I-130. Here is a link to someone that was in your situation.It may help to contact them.Good luck and God bless.

Why would you contact a newbie poster who hasn't posted in a year or more when there are other people helping you in this very thread?

Have you found the appropriate VJ guide?

As Harpa says, you must read the guides here on VJ. You will select the link that says "US citizen and spouse both reside in the US". You will be submitting the I-130 and I-485 concurrently (plus the accompanying forms). Good luck, I think you should be fine.

Oops, I meant to say that you should also check the Forums page and look specifically for the forum

Adjustment of Status from Work, Student, & Tourist Visas.

There are others in your situation, and whatever questions you have at every stage of the process, you will get an answer. I also found the sample interview questions and reviews of interview experiences that are on this website very helpful.

You dont have any problems.

Just go through the normal AOS process, have the normal documentation and you will be fine.

it is called Adjustment of Status.. so you can adjust from anything(Legal entry) to permanent residency.

AOS FROM F1

Met -January 8th, 2011

Married - February 1st, 2013

5/29/2013 - Mailed AOS Package to Chicago Lockbox

6/03/2013 - Package Received.

6/06/2013 - Check Cashed.

6/07/2013 - Receipt Date on NOAs - Transferred to National Benefits Center.

6/11/2013 - Received Hard copy NOAs.

6/14/2013 - Biometrics Appointment Notice.

7/08/2013 - Biometrics Done and Successful in Baltimore.

7/17/2013 - I-485 status updated to "Testing and Interview".

8/07/2013 - Interview Notice Received.(online/text).

8/08/2013 - Interview Notice Received.(Mail).

8/09/2013 - EAD Approved.

8/17/2013 - EAD Received.

8/22/2013 - SSC Received.

9/12/2013 - AOS Interview - Further Review needed.

10/03/2013 - AOS APPROVED!!!
10/15/2013 - GC Received.

.....till 2015.

30/09/2015 - Mailed ROC Package to Vermont Lockbox

09/11/2015 - Biometrics Taken in Baltimore

19/08/2016 - RFE received

12/10/2016 - RFE response package sent.

04/11/2016 - ROC APPROVED!!!

25/11/2016 - GC Received.
