Hey there everyone ,

just a question i am getting ready to send my forms for AOS for my green card

i am planning to be at the birth of my twin sisters first baby birth in ​October and im not sure what kinda of proof i need to help my case. Whould a letter help from her or some records to say shes pregnant?

Also Is the Fee $360 on top of the $1070? or does that get waived because im filling all together?

What if it doesnt get approved is the $360 refundable if it doesnt go through?

Hi pamala! The fee from the EAD/AP its waive in your case so you just need to send $1070. And you don't need the give major explanation or send any kind of proof to get your AP. If you filed everything properly, the AP is grant it even if you are traveling or not. But file right away cause takes 70-90 days to get it. I think you are running out of time if you want to be with your sister by october

thanks so much for your quick reply. Im happy its not a extra $360. And i am applying in about 2 weeks i hope it still gives me time. And i hope that i have everything done correctly.If i get a RFE and my case is still processing with AOS would they still process my AP?

I notice you enter the US almost 2 years ago, so your I94 its WAY beyond expired. You can get the AP but you shouldn't leave the country under this circumstance. You stood out of status for way more than 180 days, so if you try to reentry with the AP, you can get a 10 years ban and get deported even if you are married within the 90 days. Wait for your green card even if that means not going to your sister's delivery.

Oh no really ?

I know we have left it a long time its been complicated but waiting for my Green card would be 3-6 months or more

Evan if i leave with the AP are u sure they wont let me back in because im still processing my AOS

I know filling for AoS can take a little because of the money or the paperwork. But you entered on nov 2011 so your i94 expire around february 2012 a year and half ago. It's too much time. I'm almost a 100% sure. This a common topic here in vj so you can look for other's experiences. Is too risky. The immigration takes your time out of status as overstayed after 180 days. You won't have major issues to get your green card and other documents, but I strongly recommend you not to leave the country without your green card in hand.

actually no, its funny cause I didnt send nor a single photo of our wedding or my new life here. Its basically a lottery

Its upsetting ive given up alot and i have to miss these special moments in life cause i dont live in Australia no more

i know once i apply the out of status is forgiven, I just wish they werent so strick and complicated.. But im glad i know now not at the last minute

oh dear! I know I totally understand you! This the ugly part of living abroad. While I was waiting for my AoS my mom was diagnosed with breast cancer and I couldn't be with her during her treatment. It was so painful not being able to be there when she needed me the most. But at least she is ok now! But I missed my family birthdays, vacations, and tons of great memoried and now that Im expectong my first baby its even harder not being able to share every single step of it. But see the bright side, pnce you ger your green card you can go a see them abd spend quality time together without worrying if you are gonna get deported at the POE. Good luck honey
