Timeline

Hi,

Myself and my fiance recently put in for our k1 visa. However, in feb i had a 214b rejected form the London embassy.

My question is are there any implications to this that will effect my k1 application and if I was to try to travel to the US for a week in october (Half term at the school i work at) would i be allowed in or is it not worth the risk with my K1 in process with my 214b denial?

do you hold a passport from the UK ?

Applied for a J1 work visa as i was going out to work, yes its a uk passport.

It depends on the reason you were denied a J1. If it was because of crimes, drugs, disease then you would be inadmissable as a K1 also. But if it was for a different reason that is particular to a J1, but not a K1 then it should be fine if you meet the K1 requirements.

Visiting. Do the ESTA application online. Answer YES to "have you ever been denied a visa?"

See if the ESTA allows you to travel.

Your travel on VWP is hampered because of a denied visa, not because you have a K1 in the works.

i was denied on the ground of not having strong ties to the Uk. I just dont want to pay for a flight and then get denied at the US airport. And if this does happen i think it will look bad on my K1 petition.

Advice? Don't go?

If I were you, I'd:

Apply for the ESTA, see what happens. If it's allowed, then attempt to travel, but take with you as much proof of ties to the UK as you can.

If you are refused entry, I don't think it will affect your K1. But I'm not certain on that.

You didn't follow what I posted. NOBODY can go to the US on VWP without an approved ESTA application. If you truthfully answer yes to denied visa, then your ESTA may not be approved. No ESTA, no trip, no money spent on a ticket. It will cost you $14 to get your answer and you can do it today. Do it here https://esta.cbp.dhs.gov/esta/ It's your first step before you worry about CBP because you won't even be able to board a plane to the US without ESTA. Edited by Nich-Nick
