I\'ve been in the U.S for three years and three months. Two as an au pair/ J1-visa and one as student/F1-visa. My fiancé and I decided to get marry and we are going to the court house on July 26th. I am taking summer classes off because they are not required and also because we just moved to a house together. Fall classes at the college will start on august 22nd, but I am worried that we will not have enough time to send all the paperworks before the beginning of classes. So my questions are:

1) Can I do the medical exams before we get marry? I know the exams might take days to be ready, and I will need the medical report to send with the I-485 petition. There will be any problem or inconsistence with date if I do that before getting married? Which last name should I use, mine or his? Since we will get married anyway.

2) What happens if the USCIS receives my package after my classes have started? Will I be considered out of status for not taking classes, even though my fiancé will apply for my permanent residence?

What should we do? Help!!!

Hello there:

First of all, CALM DOWN, there are ton of people who went through the same steps you are thinking of taking. So, just relax. Read this website like your bible...it has more information than you think, just takes time to dig out the ones you could find useful. Anyway...

1. To your first question, I think you could take it before you are married, but I am not 100% positive. The exams (in my experience) took one appointment. The first time when I walked up to the front desk telling them what I'd like to have they gave me a list of what I need to be checked for, as well as have the vaccination history cleared, if not, have it administered (the one that is age appropriate). So I went to my own physician got those tests they needed (blood tests mainly for TB etc. and on urine test I believe for syphilis). Anyway then I made went back to the civil surgeon on the appointment that I have made at the time when I went in and got that list of paper from them to be checked for. Anyway, I went back, and got rid of $300 just so that the civil surgeon can see me face to face. They checked my eye sight, and doc asked a zillions of things (medical history basically) and then so long he filled out/signed the form and got it in a sealed envelope. So really, it does not take that much, this will not delay much your mailing of the AOS package (unless you really have a ton of things to make up for in vaccination, or if you happen to test positive for something you're not supposed to). In terms of the last name usage, it is up to you. Really. If you don't want to keep your own name, you can use your spouse's. This really up to you. Keep in mind, you can change your name once you're getting your naturalization without any pain (only gain). Just thought I'd throw that in there...

2. In terms of your status you make a field trip to your international office and tell them that you have filed for AOS. They will tell you that you have two options:

A) do not keep your F1 status. That means you don't have to be registered full time. Which is good. Bad side: if AOS fails, you have to pack up and fly back home.

B) You want to keep your F1 status until your AOS is pending. Bad side: you have to be registered full time just like before you submitted AOS. Good side: in case AOS fails, you can finish your school (years/months whatever you have left) as an F1 student instead of immediately having to pack up and go back home.

I would recommend B)...seems safer in case AOS failed. Which is not likely, but still. I feel better to be safe than sorry. If you know what I mean. In terms of tuition it really does not matter, as even after you have your GC you have to be a resident at least one year (varies by states and schools) in order to have resident tuition, so for one year you'll see won't be resident for tuition purposes even though you'll have your GC...
