Question about divorce decree from previous marriage.

Hello everyone. I have a quick question about filing. My ex-wife moved out last year, we weren't in a hurry to file for divorce at the time. After she moved out I met Marife and we got along very well. So I went to the Philippines to stay with her and her family on my birthday. Before I went there I tried filing the divorce papers, but incomplete info kept getting it kicked back. Anyway, we wanted to get all of our papers ready to go so we could send them out after the divorce decree was issued. The decree should have been issued around the 22nd of June. We thought we'd be safe and put June 30th on Marife's and my papers. So she could mail them to me ahead of time and I can get everything ready. But due to whatever reason the court didn't get to finalizing things until today, July 1st. I am wondering, should I have my fiance fill out new papers with a date later than the the 30th or if that one day is going to make a big difference.

I would definitely put an updated date just in case.. last thing you want is someone calling you out on that. .I don't think it would get caught, but details are everything with this stuff

You have to be Free to Marry. A Certified Copy of the Divorce Decree is Required for the 129-F. So you are kidding yourself.. Don't pay any Fees or submit anything without that. You are just setting yourself up for a RFE and a Denial. Thats my opinion.

her papers? with the exception of the G-325A -

it's YOUR papers that you submit with the I-129F.

A photo copy of the certified copy of the divorce decree.

fast forward to Manila IV document intake, and she has to submit several different forms for HER visa application. One of those will be the certified copy of the divorce decree.

OK - I'll bite - what 'documents of hers' are you waiting on to submit the I-129F petition ?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

yeah good.. just send a copy of that thing with the court stamp and the initials .. in my state it is a dissolution, yours is a decree? is that right? .. and you wont need to send the original at any time

In my opinion, the date on her intent or her G-325a don't necessarily need to be after your decree. Both of these documents can still be true having been filled out the day before. Your documents though must be dated after receiving the decree. You can't say you are free to marry her when you aren't. She's perfectly free to marry, so hers are probably ok.

Now, with that said, although I think hers should be fine, I wouldn't risk it. It's not worth the stress you will inevitably feel during the wait time for processing, always wondering if they will deny you because of it. If it were ME, knowing the anxiety one can feel during the wait, I'd go ahead and get newly dated papers from both of you and then file. The feeling of security, knowing you did everything above board and properly is well worth it in the long run.
