I am currently in the middle of an I-130 application which is dragging on and looks like it is not going to be done in time for both of us to move to the apartment which we have signed a lease on so that I may attend the graduate school which I have been accepted at. If she is not able to move in time to be with me this will cause severe financial hardship on both ourselves and our families as well as severe emotional hardship on us personally. Is the I-601 something that could help me, and if it is, do you think I would be able to get one?

you are asking about an expedite

doubtful you will be granted one

more folks here on vj are denied than approved for expedites, even with situations far more stressful than yours

that being said, the only thing you risk is a "NO"

you really are not that far away.. have you done all your nvc prework? the only thing that seems to be takin time is the ds3032 acceptance

You can obviously try, but I'd prepare for it being a no. Careful with financial appeals, remember that your spouse is coming under the terms of the affidavit of support, so you or you co-sponsor should be able to cope without income from her.

Also, stick to financial hardship as the focus. Everyone here apart from their spouse is under emotional hardship.

You can only file the waiver after the visa is denied. Has your wife been denied a spousal visa?

If you have to file a waiver for her, then what did she do to get a ban?

The US will not care about your financial hardship because you carelessly and intentionally created it. No one without an immigration visa should be signing a lease in the US. The US specifically advise that intending immigrants make no plans until they have visas. If you make unwise financial choices, then they are your problems. There is no relief for creating a problem and then requesting a expedite.

There is a popular saying - "Your inability to plan does not constitute an emergency for me." Your inability to plan your finances by making changes does not constitute an emergency for the US government.

Emotional hardship? How is your separation any worse than any other separated couple? If you want to claim an emotional hardship, have either of you gone to get medical diagnosis of this emotional hardship?
