Hi, I'm just trying to read up on the I-134



My fiance will be able to produce recent paystubs, a letter from his employer and a bank statement. His income is above the 125% poverty threshold.



However, I also read in the forums that it is a good idea to bring the past 3 years' tax returns.



My fiance is the USC. He recently graduated and only started working June 3, 2013. Before that, he hasn't had any income, and has been single and living as a dependent. The IRS website says he doesn't need to file tax returns in 2012 http://www.irs.gov/u...e-a-Tax-Return?.



My question is, will he be able to file back tax returns and get statements for those to be used for the I-134? Are these necessary for I-134?

Yes he can back file and it is not necessary for the I-134. After the visa approval and he has to file the I-864 form then it is a whole different set of rules and requirements. He can use the link you provided and show that he was not requried to file an income tax return or back file with zero income just to have the form for the USCIS. Up to the two of you how you want to proceed.

If he was not legally required to file taxes, then no need to file them now. He can provide a statement that he was a student in 2012 and his income was below the threshold and he was not legally required to file. A statement works for the I-134 for the K-1 as well as for the I-864 when you adjust status.

I see. As we're still waiting for our NOA2, we will probably produce a statement, and also try to backfile (if it isn't that expensive) in case they want the actual return forms in the future.
