need help with taxes, did not make enough money!!!!

Hello, I received my Noa2 and have some problems with the financial portions.

On my 2012 tax return I made $16,400, the 125% poverty amount is a little over $18,000. In 2012 I was not working for 3 months because I went to Italy to visit my fiancee. When I came back it took me about a month to find a job. I didn't receive and income for over 4 months and if I had been working and not gone on that trip, I would be well over the 125% amount of 18,000. Would the immigration department accept this if I wrote a letter saying I did not work for over 4 months and that I would have had the money or will they just not accept it and that I would need a co sponsor?

In 2011, I made $25,000 so I should have no problems.

In 2010, I believe I was a student part time plus I was working part time so I only made around $9,000. Does the immigration need this year of tax returns or do they only need the last 2?

Currently I am working a good job and my work letter will say that I am currently employed full time and that my salary will be over $30,000. Does anyone have any info that would help on this situation. I really don't know if finding a co sponsor is an option for me so I hope I letter explaining why my income was so low in 2012 will help. Thank you very much!

I'm pretty certain it is based off of what you are currently earning....not what you earned in the past.

You should be fine.

I'm sure others will weigh in as well.

A blip from last year's tax return will likely get them to take a little deeper look into your finances, but shore up a little extra evidence for your current situation and I would think you should be fine.

To accomplish this, I would, on top of the letter from your employer, see if you can get copies of your most recent few pay stubs to add to the letter so they can see for themselves what you are currently making.

As stated it is CURRENT earnings, not past earnings. Include a letter from your employer and the last few months pay stubs and you should be fine. In the event they decide to be difficult, I'd start scouting for possible co-sponsors, just in case.

ok this is my problem... I only made about 5000 last year and this year my income would be around 7000. My dad is going to be our cosponsor for my fiancé. For a family of 5 plus my fiancé meaning for a family of 6 the income has to be 39,487 per year. Last year he made about 38,800 and I made 5,000. I know they do not combine the income but if he has a letter stating that he he works apprx 54 hours a week which he does sometimes and he gets paid 12.81 per hour for 40 hours and 19.21 he other 14 hours a week that add to a total of $780 per week. multiplied that by 52 and you get 40,560. Will we be ok with that? Can my dad be our cosponsor?

. I KNOW that we need the 125% for the AOS.my dad makes between 38000 and 40000 per year. And we do have the letter from employment. He also owns a house well we are paying it off. He has 1 vehicle fully paid off. He has a retirement plan at the bank with a pretty good amount of money. Can we present the house documents, the vehicle document, and the bank documents as long as the letter of employment and the tax transcript from last year even if he made 38800? I understand that it is better to make the 125% since this will be a requirement for AOS and me personally will have a job where I will be making 125% for both of us when AOS time comes around. So can my dad still sponsor him with an income of around 38000 and 40000? We have interview at Juarez and I know they are pretty laid off with the financial requirements. Can they accept the 100% for the fiancée visa?

this is the info I found...

Proof of Financial Support and Affidavit of Support Forms

During the visa interview, applicants will be required to present evidence to the Consular Officer that they will not become a public charge in the U.S. You may present evidence that you are able to financially support yourself or that your U.S. citizen fiancé(e) is able to provide support. The Consular Officer may request that a Form I-134, Affidavit of Support be submitted by the U.S. citizen fiancé(e).

The U.S. citizen fiancé(e) will need to submit Form I-864 to USCIS with the application for adjustment of status to that of legal permanent resident following the marriage.

Do the Same Income Requirements Apply to Form I-134 as Apply to Form I-864?

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when Form I-864 is needed. Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.
