So I've noticed that the NVC has been asking lately about the 1st and 2nd paragraphs of my notice of action when I call to inquire if it's been received yet.

Now I've been under the impression that all of them have the same text on it, and I'm wondering if that has changed, and if it affects where it's sent.

Here's what mine says:

The above petition has been approved, and forwarded to the listed consulate. Please contact the consulate with any questions about visa issuance, or or if you would like them to forward it to a different consulate. The petitioner can also file form I-824, Application for action on an approved application or petition, to request that we notify another consulate of the petition approval for visa processing purposes. THIS FORM IS NOT A VISA AND CANNOT BE USED IN PLACE OF A VISA.

When the person this petition is for enters the U.S. based on this visa, he or she will be admitted for ninety (90) days in order to marry the petitioner, and based on that marriage file for adjustment to permanent resident status on Form I-485. The form to apply for adjustment can be obtained at any local USCIS office or USCIS form center. Please attach a copy of this notice to the adjustment application when you file it.

Anyone else's say anything different?

That's what mine says as well, verbatim ... although mine goes on with two more paragraphs which I'm a bit too lazy to type in. smile.png They say what would happen if you don't marry in 90 days, and that USCIS/DHS reserve the right to perform further checks on your information. But the beginning info is the same, and is not exactly CORRECT for K-1 visas since the NVC still gets the file before the embassy does.

I'm guessing you want verification: my NOA2 says "forwarded to the listed consulate" but in FACT, it was forwarded to NVC, arrived there 10 business days after the NOA2, and was shipped out to Finland last week. According to DHL it arrived Monday, so we'll see if the embassy contacts my fiance in the next few days. That bit about "forwarded to the listed embassy" is just boilerplate and wrong, it completely fails to mention the NVC stage.

N400 filed September 14, 2023, same day acceptance and Biometric Reuse notice, Interview on 2/13/24: Passed and same day oath. ALL DONE WITH USCIS.

Yes, I didn't type in the whole thing, but that's it. I know all cases go to the NVC, but why would they be asking that all the time now? I wanted to double check to see if something may have changed.

After waiting for so long, I don't know why some of us didn't make it to the NVC in a timely manor, and I'm looking for some kind of an explanation.

Honestly, because the phone reps don't know any better. They aren't trained and simply read from a script. The forms are all the same (I think), and it's definitely true that ALL K-1s pass through NVC on the way to the embassies. If the phone reps say differently, they are just clueless.

I'm really sorry for your situation and delays, and cannot imagine being in your shoes. All I can say is, I don't think the phone reps are going to do you any good. Either your case will eventually get to NVC mysteriously late, or better (if you haven't already), get your congressman involved because that's the only actual pressure you can put on them.

Guys remember this is the US government, they are not always clear, this does not indicate an issue with your filing, I would view this as FYI. It is not a visa, you must meet the requirements of the k-1 visa when issued in 90 days. DOS to NVC to your embassy and a successful interview. I have noticed issues with new filers (and a lack of understanding of the process), so mabye they are attempting to further explain what is happening and the rules in brief.

How do I know my case has reached the NVC or that they sent it to my Consulate? Do I have to call them(with the case number on the NOA2)? How do I know when they ship my case to consulate? I see people on VJ posting dates when their case left NVC and arrived at consulate.....

Did calling your senator help your case? right now my case has been stuck in the same limbo, I received my NOA2 about 5 weeks ago and still waiting. NVC keeps saying they dont have it, and USCIS keeps giving me their scripts everytime i call...

If after 2 weeks u don't see case in NVC, u can submit request at USCIS and NVC, they have different days require for you can doing that, so what you really can do, just waiting that day, and submit your "anger" and pray they find where it is and quickly. senator can't do much like help u jump into a quick queue, but they does can give a push, and reminder people don't forget u. so yes, contact anyone include senator as u can, like Rob said

FYI, your request, have to like asking "Send my case to NVC" instead of asking "where it is". because those people they like machine, will just answer your question where it is, and don't do anything about it.

So how did you get the tracking #? Did you call NVC to get it? Thanks for your help! :)

Thanks, Ill connect with these people in 2 weeks.. They just opened some case with USCIS .. a "service request", they said they will contact me in 2 weeks... If they contact me in two weeks it will be a miracle, I mean I would be amazed if I get any contact back from them. Im just hoping the senators office can get them to move something around and check where the file is.
