My fiance had his medical check up at st lukes and admitted on using "shabu" once in the year 1999(gggrrr!!) . Advised for a psych eval and psych just asked basic info and family bacground ,nothing about drug use. Then after ok'd for Immunizations . Will have interview at usem this month. Any advice during the interview and any hope for approved visa ?! Huhuhu... And also in ds 230 form should he say yes to the question about drugs? Pls helppp! Thank u!

He wouldn't get an interview if his medical wasn't approved. It sounds like they have no issue with the fact it was once in 1999. Generally what happens is when its a current or last year issue the interview does not happen, the medical is not approved and the entire process is put on hold for a year while they do drug tests.

I don't believe you have any further issue with this.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

He should answer truthfully on the DS-230 form. No use hiding about the drug use as it is already mentioned on his SLEC medical record and the US Embassy Manila has that record as well.

I have seen people get a ban, have to retake the medical and pass a drug test before having another interview, a year later. I have also seen people admit to using once and get approved with no problem. Just be honest and hope for the best.

For a K-1, it is my understanding that you only fill out Part 1 of the DS-230. I do not see any questions about drugs in Part 1.

For #40 b. in Part 2, even if you did have to fill out that part, it talks about criminal activity and trafficking. I would not check yes to that.

yes but it asks for admitted criminal activity which this person has already done and was most likely documented by the examining doctor.. I would be totally truthful across the board with documented evidence

I suppose, but there is some strong wording in that phrase you are to check yes or no to. I would be very wary of saying yes to something with phrasing about drug trafficking in it. It is a moot point though, because for a K-1 they do not have to fill out Part 2.

I know where you are going with that, but the verbiage is closer to admitting criminal activity and since it is an illegal drug and already having been admitted to the physician and most likely documented why lie? trafficking was not the question

Secondly if it was an issue at the doctor's evaluation, there would have been a drug test.

Personally I wouldn't do anything that would appear to be avoiding the truth or lying on this very important part of the application.
