Hi,

I'm in the process of filling out the AOS.

I work in Singapore at the moment, living with my wife who is a citizen of Vietnam. I've recently purchased a home in California (with both of our names on the title). For the AOS, I'd like to only use my assets to qualify me to avoid listing my job in Singapore as this could only complicate things. I plan on quitting my job when we secure an interview date. I do not plan on working immediately when I return full-time to the U.S. as I intend to study for LSAT to get into law school (big career change).

I have many times over the assets to qualify me above poverty - money is not the issue, just getting through the visa process.

Questions for experienced vjers:

How to fill out the form if my job is overseas (standard issue I.T. industry job)?

Does an overseas job qualify for this support? I have no W2s as those are only issued in the U.S. I have filed all tax returns every year, and as "Married, filing Jointly" for the 3 years we've been married.

Domicile should not be an issue as I have a U.S. home (paid for and under both names), car with car loan, utility bills, life insurance, voter registration, etc. I also am back in the U.S. once a month living in my home there. I have only used my U.S. address on the AOS form for both residency and mailing address.

So what is your advice on how to fill out the AOS form? Should I list my job? And if not, what do I put instead? The options are "job", "Self employed", "retired" or "unemployed". Do they accept non-U.S. jobs?

Yes they accept Non- US jobs (atleast in my case they did). On my AOS I listed my Indian job, and attached my US tax returns with the Indian equivalent of the WS - the form 26 AS.

Filed for DCF for my husband in New Delhi, India

Timeline:

29-06-2012 - Got Married in Bangalore, India

04-04-2013 - Filed the I-130 in person in New Delhi

No NOA1, NOA2, Packet3, Packet4

26-04-2012 - Interview Letter sent out

09-05-2012 - Interview letter received

24-05-2012 - Interview Date

Interview Result - Approved

Filing to interview date = 50 days!

Yes they accept Non- US jobs (atleast in my case they did). On my AOS I listed my Indian job, and attached my US tax returns with the Indian equivalent of the WS - the form 26 AS.

What did you supply in addition to the form 26 AS? Did you include 6 months of paychecks as well? A letter from employer that proves you work there?

Anything else?

With the AOS i didn't supply anything else. Since I filed through DCF, I had to prove I was moving to the US so provided all of those documents.

Have you considered the DCF option?

Janani's case is extremely unusual, foreign income is not normally counted unless it will continue from the same source once you move to the USA- I am thinking someone at the embassy didn;t realise his job would not. In addition, there is no DCF option in Singapore.

If you will have quit your job by the time the interview comes around, just put 0 as current income. However, if you have the job still, list it and your job title, but they will not count it in normal cases, because for the affadavit of support, income needs to be current AND ongoing (so you can support the immigrant when they move to the USA).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

That's what I thought too... so what should I put in the AOS in my current situation since there are only 4 options (and you can't leave it blank)...

1) Job

2) Self-Employed

3) Retired

4) Unemployed

The only option for me is #1 since I have a job, but I am working overseas, so how should I file? List the job, provide payroll slips and also all assets just in case the job doesn't do it?

yes I will quit at interview time.

Hi VJers,

I have maintained my residency in the U.S. (I have tons of supporting evidence including deed for a house fully paid for, etc.), however, I still temporarily reside in Singapore with my wife (citizen of Vietnam).

My job is based in Singapore at the moment, but I plan on quitting at or before the interview timing. I do not plan to continue employment in the U.S. as I will start to study for LSAT to get into law school.

I have far more assets than I need to qualify, and have filed all tax returns 'married, filing jointly' with my wife's name on them.

For the AOS I-864 form, should I list my current employer in Singapore and provide last 6 months of payroll slips? Will that be counted? Or should I also list assets (all based in the U.S.) to qualify in addition to my Singapore employment?

Really need help with this - need to file within the week.
