I married my husband who was from Pakistan in April 2009. He was already in the US maybe 10 years before. We had an appointment in Philadelphia at the immigration office maybe 3 years or more ago. About 6 months ago some guys with badges knocked on our door and searched around my house. Please forgive me, nothing makes me more confused than this immigration stuff, I just can't figure it all out for some reason. But anyway, when I check the status at the website it still says initial review. We have had a laywer the entire time, he even flew in to go to meeting in Philly with us, at a cost no doubt, but he was there. What is taking so long, it's been over 4 years now. This is for a L130. The lawyer last week requested me to write a letter, I don't even know what I am writing about. I have been looking around this site so I got an idea, but I hope I am saying the right things. Anyone have any input for me, or help. Thanks!

You had an appointment in the USA? did you file the I-130 and the I-485? or just the I-130?

Is he still in the USA? what did he enter on?

We had to go to Philadelphia to the immigration office. He is in the US, never left since he came many years ago. Now as to the question to what did he enter on, all I am going to say is, it might not have been the right way to get here. It's been like 20 years I think since he came, and he has never left. I am not sure of all the numbers he filed, the laywer did everything. A little about me, I am unable to work anymore, been on disability 2 years now. I have life long restrictions-5lb weight limit, no more than 1 hour walking a day, 3 hours sitting or standing. I have had a few back surgeries that screwed me up, and will need more. I was married before, 12 years, have 2 kids to ex and we split custody 50/50. I moved in with husband in his home he owns and my kids go to this school district, so I cannot move. He has 3 businesses here that he runs. I don't know if any of that helps, but thought I would throw it in there.Oh and the guys with badges was home land security, 2 of them came. I was kind of shocked I didn't know they did this, and they just showed up one day. I didn't mind, I have nothing to hide, just didn't know they did this.

When they showed up, did they state why they were there?

and

what did they do ?

I have to think you two are chasing after a greencard, hoping that a complete 'adjustment of status' set o paperwork was filed, an I-130 + an I-485 + I-864 plus a whole bunch of other stuff.

We can help you with some triage on what's what, but please confirm with the attorney (or study the paper file copies of what he's given you already) exactly which forms he filed.

re: the online system - many times, it's never updated...

for casefile status - is best to call into USCIS (tomorrow), ask for an ISO, and ask the ISO for the status on the casefile.

You've posted in one of the VISA sections - folk in the USA mostly don't chase after a visa - instead - they chase after a greencard by filing for an adjustment of status.

No worries, about it - but if all that was filed was the I-130 - that's simply not enough.

I invite you to write more here in your topic, telling us dates of major events - or at least Month and Year.

Moved from Spousal visa to adjustment of status from work student tourist as the OP cant be filing for a spousal visa inside the USA and should be filing to adjust status.

You didn't say if you filed both I-130 and I-485 but you would have had to file both things in a package to get anywhere. Like Darnell said filing just an I-130 while hes living in the USA isn't enough to get anywhere with immigration or get his status taken care of.

Now as to the question to what did he enter on, all I am going to say is, it might not have been the right way to get here.

My questions is rather, does that mean that he entered without inspection? Wouldnt that mean, that he isnt eligible for AOS? Or what should this mean?

Without giving details nobody can help here...

this is very confusing, ur not giving people enough information in order to get the best advice, please try and give a full load down from the start including how he enters, and what was filled, the response from uscis, and why they came to search the house and what was said during the search,
