Traveling Before Submitting RFE Response

Timeline

I received an RFE late April and have till July 12th to respond. I had made plans since the beginning of the year to travel June 20th - July 25th. I have the RFE response packet ready to send back to USCIS. HOWEVER, I am afraid if I do send it back now, I might be requested to attend an interview within my travel days.

My husband is going to travel to the same destination July 10th and we will back together on the same plane. He suggested that he mails the packet by July 1st, just in case we receive an interview letter, we would be able to make it back home within 3 weeks or so. I am not sure if that is an ideal solution since I (LPR) am the primary applicant for my ROC application and I am not going to be present in the US at the time he suggested.

Should I mention my travel plans in the RFE cover letter and explain why I chose to send the response back right before the deadline was up? Should I call USCIS give them my travel dates and let them know my willingness to go for an interview before or after my travel dates?

i think it's a bad idea. beside interview dates takes forever to get one. so i'm assuming even your back from vacation you probably either waiting for RFE approval OR waiting for available dates for your interview.

but anyhow, it's your own desisyon.

This trip is very important to me as my parents are going to meet their first born granddaughter this summer. The travel dates were already set before we received the RFE (they are only requesting more financial proof).

I think that's not a bad idea at all!

If you look at my timeline on my signature below, you will see when I received the RFE and when I responded and when I got an interview. But since I filed the 751 waiver, I was pretty much guaranteed an interview.

Different offices have different timeframes but your plan makes complete sense and I don't see anything wrong with it.

Most interviews are given ample time for you to attend. Personally I have tried to get my RFE's in ASAP and get it done. It's your call, and you have prior advice.

They usually give you 2,5 month to respond!But then they can tell how fast you collected the evidence. It is your choice, but I still don't understand why are you consuming the time

Because I don't want to receive an interview date within the dates I am travelling.

Personally I wouldn't put it off, but I don't think your plan is a bad one either.

When we turned in our RFE we got a reply within about a week's time that we were approved.

There's a chance you might get an interview but it's not a guarantee. I would suggest mailing in your papers already if you have them and just state what dates you'll be out of the country if they do request an interview. Who knows you might actually be approved and have your new greencard before you even travel.

This trip is very important to me as my parents are going to meet their first born granddaughter this summer. The travel dates were already set before we received the RFE (they are only requesting more financial proof).

They do not interview every single case where they have rfe, if in your case they were just asking for more financial proof than maybe thats all they need.

That is why I am not to worried about the RFE. I understand that we could or could not be interviewed, and with the travel plans and everything I'd rather be on the side of caution and know all my options.
