Applying for Change of status after the expiration of lawful status

Can someone explain this, was checking USISC page about concurrent filing, are they saying that if VISA number is available you can't send both forms together or what ? o.o

I know it can't be that but just want to make sure.

Visa Availability and Concurrent Filing

A petition and application may be filed concurrently when there is a visa number immediately available at the time of filing. Concurrent filing is always allowed for all immediate relatives of a United States citizen, since there are no numeric limitations in this category. However, in some categories, even if there is a visa number available at the time of filing, concurrent filing is not allowed as the intending immigrant must have an approved basis of eligibility (i.e. an approved petition) before being allowed to file for adjustment of status. Yes, a visa number must be immediately available to you (or you are also filing a supporting petition that, if approved, would make a visa number immediately available to you) in order to be able to file an I-485.

Visa number? but the visa number is on my passport already, what do you mean by it will be available to me?

An immigrant visa number must be immediately available to you. This is unrelated to your nonimmigrant visa number.

In the form i-485 there is a question about your spouse and 'Are they applying with you?'

I don't exactly know if i put yes or no, i mean i'm applying through him, he filing i130, so in that way he's applying with me. But he's not applying for his adjustment of status, if that's what they're asking.

Can someone confirm it for me?
