Name on Passport vs. Name on Green Card

Hello,

So a few years ago when my wife successfully completed her immigration they refused to let her use her married name (my last name) during her immigration because it didn't match the name that was on her passport. Now her passport (Canadian) is about to expire which means it is time for a new one and we'd like to get her married name on there.

Will this screw up anything with her name on her green card or will there be more forms we have to fill out to make it happen? I'm having a hard time finding any examples of this on this site.

Yeah - I think that is what I was just reading. To me it sounds like the order would go something like this:

1. Renew passport, but reflecting her new name - using marriage certificate as proof

2. Fill out an I-90 form to replace her current green card based off of her new passport and our marriage certificate

3. Live life successfully having my last name for the rest of her life.

Does that seem right to everyone else?

Also - This is the first time I've seen the term "ROC". What is that? She's already made it very clear she isn't going to go for citizenship.

Removal of condition - Got it! Yeah, that has already happened. She's permanent resident now and they wouldn't let her use my last name because of the name on the passport.

Oh well, what's another $485 to reduce the complexity of having two names.

Yep thats pretty much how it would work! - Double check the requirements for the Canadian passport/name change on it tho in case they want ID with the married name on it. I cant remember what it requested for ID and such when I filled a few years back.

She could wait till citizenship if she wanted though, unless she does not plan on becoming a citizen soon or at all.

Honestly, I suggest waiting until she gets her citizenship interview if it's not too far off.

I maintained my maiden name on my passport, and my (former) married name on my green card and all American documentation. I always made certain to carry a copy of my marriage certificate when crossing the US border into Canada or abroad. I never once had a problem traveling on my Canadian passport or re-entering the US using the green card in a different name. I usually only had to present my green card and driver's license from the US along with the passport and I was on my way.

You *can* do a change of name based on the marriage certificate:

1. File for a new passport using your marriage certificate, as per normal, in Canada.

2a. Keep your green card as is.

2b. File for a new green card.

Is the investment worth it to you for the new green card? If she's eligible under the 3 years of residency proviso for naturalization, then save the $450 to put towards the application fee.

27 June 2005 - Sent package off to Chicago lockbox.
28 June 2005 - Package received at Chicago lockbox.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
