So i receive RFE yesterday ,i wouldnt say i was stupid or ignorant but i didnt actually know that there exists form i-864 so i filled in form i-134 and thus RFE stating this "Submit a completed and signed Form i-864 blah blah blah and also provide copies of the petitioners/sponsor most recent federal income tax returns"So here are my worries

1. My wife is a USC but came to the U.S. last year for good and started working 7 months ago so she filed taxes return for the first time this year.We haven't received the returns yet so how do i get the federal income tax returns they want?

2. I know when u get RFE the process is brought to a pause till u submit the required information,does this affect EAD or Advance Parole?IS everything paused?

3.My wife has a shares in the stock market ,do we need to provide a statement while submitting this?What other documents are a plus?Do we need a joint sponsor?

4. How do you know if your income exceeds federal poverty guidelines for any household size?We dont have kids yet.

I was given 90 days so i have pretty of time but i do want to do it as soon as possible.Any help will be greatly appreciated.Thanks VJ people.

DAY 20-Apr23 NOA1 Hard copy through mail
DAY 23-Apr26 Biometrics letter received through mail scheduled for May 14

DAY 36-May 9 RFE in mail

DAY 42-May15 Walk in biometrics taken at San Francisco testing centre

DAY 91- July 4 RFE sent

DAY 95- July 11 Case moved to RFE reviewing

DAY 103- Infopass appointment for Advance Parole (travel document) San Francisco... Issued same day on spot.

DAY 114- July 22 case moved to Interview and testing

DAY 116- july 24 EAD card in production

DAY 121- July 29 EAD card received in mail

DAY 124 - Aug 1 Interview appointment notice received on mail for August 28

DAY 132 -Aug 28 Interview held SF Case to be reviewed decision in 30 days

DAY 136- Sep 1 Green card Approved

DAY 138- Sep 3 Green card production Ordered.

1 - She needs to send the tax returns for 2012, in principle. If she filed already all she need do is submit the 1040s.

2 - Yes. Everything is paused until you provide the USCIS with the required information or documentation.

3 - If her income alone qualifies, she needs not present any other source of income, otherwise she will need a co-sponsor. She might however want to attach a copy of her investment account statement for good measure.

4 - Check the table in the link below:

1. She was supposed to file return even if no tax is due (and even if she is not in the country). She can file returns for prior years now.

2. Not only it pauses, but there is some time limits to reply to a RFE, you cna't just wait until next year. The notice should have some info on that.

3. No really, just have it handy in case it is asked in an interview

Complete tax return isn't just 1040 - it's also W2 and all the schedules - if applicable.

Your wife should have copies of those. The 1040,s W-2, etc are all the documents that you need in order to file taxes. Even if someone did it for her, she should have a copy, else the person who prepared them must.

If her income does not qualify she will need to find a sponsor, whose income must qualify on its own.

Only a qualified household member(adult child, parent, sibling) that you reside with can be used to combine incomes with hers by filling out an I-864A. Otherwise you will need to find a joint sponsor that meets the income requirement for their own household count plus you. They will fill out their own separate I-864.
