Hello guys, i just got my NOA2 on April 30, and now thinking about all the papers for the interview. And when i started thinking about i-134 i realized i have some problems:(

I live with my fiance in Ukraine for the last year, while waiting for the i-129f and obviously i'm not working in US and i don't have incomeTax, i dont have anything i can show them except 10k on my bank account....

I was thinking that my mother can be a sponsor, but im not sure - Can she be the main sponsor? or i have to be a sponsor and she can be a co-sponsor?

if i have to be a main sponsor....i read some topics here, that people not getting approved because of that(little or no income with co-sponsor)

I am really confused and nervous about that....

Other thing if my mother can be a sponsor - she already gave an affidavit of support to my grandma like 3-4 years ago, does it mean that her income have to be more then they ask for?

she has an income of around 17-20k plus 10k in bank account, payed off car, worth 20k and house worth 350k with mortgage of 150k....

So the big Question is : What and how should i do? What would you suggest, to get as more chance as possible to get an approval?

Yes, I think you're going to have problems. Can you find another sponsor who makes more and is not already sponsoring somebody? Either that or go home immediately and get a really good job (though it's probably too late for that).

you will be the main sponsor and use your mother as co-sponsor hopefully your embassy accept co-sponsor. i heard some embassy don't accept co-sponsor.

your grandmother should be included to her affidavit of support. so her income should be for 4 household (correct me guys if i'm wrong).

asset could also included but you need to provide evidence. you could able to use your car. as long that you have 2 cars.

for my own point of view with all things you mention seems that you'll be okay. goodluck!!!

The longer it takes to happen the more you'll appreciate it when it does!

I guess that's the reason every USC on VJ doesn't just go hang out in their fiance(e)'s country to wait for the visa. They need to be at home working and showing they can support their other half when they finally arrive.

You right, but we are working here and have job positions there waiting for us, can support ourself but can't prove it:(....i didn't know anything about i-134 before, that's why "lost" right now

yes it will be counted. as long you provide or wait for your pay stub for your evidence and meet the poverty guidelines. one of the Vjer's did the same, got her AOS...EAD/AP approved after getting rfe for not meeting the poverty guidelines. she also leave overseas with her fiance before immigrating here in the US. she just recently found a fulltime job.

The longer it takes to happen the more you'll appreciate it when it does!

You will always be the main sponsor even if you have no income. Your mother can be a co-sponsor but she must include herself, grandma, and any other persons dependent on her as her household members plus the immigrant. She cannot use the primary car as this is not considered a disposal asset. She might be able to use the equity in the house, but she would have to have an appraisal done to determine it's value. Bank accounts are good also. Since she is a co-sponsor I think her assets would have to be 5X the amount required or 5X the amount her income is short.

I believe you may have a problem. You will need to show an ability to support yourselves, or have someone who meets the requirements to be able to do so. You future employer might help, but it doesn't provide the solid documentation that pay stubs and a tax return do. A letter from a future employer may or may not help, as it can demonstrate a possibility of income, but doesn't demonstrate actual real income.

As far as your mother goes, she doesn't meet the guideline income requirement for 4. Other assets including the car and home are problematic. My understanding is they accept those assets infrequently, and certain far removed from a guarantee. To be able to be used, per some previous discussion, the home shouldn't be a primary residence and needs to have clear appraisal showing the value. It needs to be a "liquid" asset, and from the discussion on this board, homes are less likely to be seen as liquid in this current economy.

In short, you may have a problem. If you can't find another sponsor, coming home, getting a job, showing solid check stubs with cushion over the requirement might be the best option. If you can't get it done it time, you might get denied over this. If you are, come home and get a job and reapply. If you do, you would qualify the second time around.

The affidavit of support is a BIG issue. There are primarily looking for 2 things at the embassy and that affidavit is one of them, with the relationship being the other (and you certainly should have no problem with that, given your situation). If you can convince the CO is the big question, and I see problems in your case.

And when it's time for AOS, you'll need to show even more income on the I864. Even though it's overwhelming, people on VJ are always advised to read through and grasp the WHOLE process right up to GC (and beyond, if desired) before beginning, rather than trying to approach it in more digestable "chunks" (I made the same mistake). Hope it works out for you!

If i got you right(correct if not)

Get a letter and first pay stubs as soon as possible to show them...and include my mother as a co sponsor, and if i have to put all of her dependant, inluding my father, and then can i show their income tax which is 44k, for both of them? Thats what is in line 22 in their 1040....

Or i can show only my mom's income?

And why my mom can't be the main sponsor? Is that the rules they have? Or it just would be better if ill be the main and she's a co-sponsor?

Very confused...
