Oh congrats...but what if you had the baby there? is it gonna be a problem?

I have a one-year-old son with my fiancee. He was born in Peru. We went to the embassy after he was born and Registered him (CRBA: Consular Report of Birth Abroad). He now has a nice looking certificate and his American passport. Just do the same thing when the child is born (of course you will go to the consulate in Manila and not the one in Lima :)

Absolutely ! The USCitizen can file an I-129F now !

She will be a citizen after we file for crba and US passport. Our problem is time, there's no early schedule for crba and he'll be here only til 1st week of July. I also hope by that time, NSO can release her BC.

It's won't be a problem if she doesn't give birth in America. I had my son in Australia to a USC. We simply made an appointment with the American consulate in Australia and filed a consular report of birth abroad when he was 2 months old. Our son is now 1 and also has a certificate and American passport. He has dual nationality - American and Australian.

Oh thanks so much..so waht documents to be presented if they register the baby to u.s consulate in manila?

They will each need their identification (passports), and they will need the baby's birth certificate with BOTH parents names on it. They will need to print and fill out form DS-2029, and fill this out but NOT sign it.. They must only sign it in front of a witness at the embassy (they will tell you when to). They will need to prove that the USC has lived in America for at least 5 years. They will have to bring an express post envelope (A4 sized) addressed to themselves. It's not a requirement for the USC to be present when reporting the birth but if he is not, then he will need to fill out an "Affidavit of Parentage, Physical Presence and Support", and have it notarized by a Public Notary (in the U.S.). It's a good idea to get the child a US passport and SSN while they're there too.. This just means a few extra forms to fill out! (And I think you have to provide USA sized passport photos of the baby too.. I can't quite remember what I had to do!) They won't get the certificate, SSN and passport straight away either, these get sent to you in the post, via the express envelope you provide.

This is only from my experience at the American Embassy in Perth, Western Australia. Your country may have much different requirements.. You should check up on it online, or on your country's portal on VJ. Good luck :)

my son was born in the philippines and i reported him through CRBA.

the challenges that you'll fae when doing the CRBA is the NSO birth certificate.

it takes forever for the local civil registry to forward the birth certificate to NSO.

when you register the baby, ask the hospital if you can forward the registration of birth directly to city hall (local civil registry) and request for an expedite NSO delivery.

once you have the nso birth cert, start with the crba docs and apply for your child's PI passport (saves your the trouble of exit fee and gives documentation for dual citizenship)

make sure that when you wok on your proof of relationship youd have pictures of being together when you conceived your child.

the entire exam is not avoided -

but - there's a modified exam performed,

and

it may be there's a medical tag put into the K-1 visa when it's printed.

She'll know more during the medical exam (tell her to go and ask for extra stuff about the chest x-ray, possibly avoided that one bit altogether)

and tell her to remind the nurses and doctor that she's pregnant.

Stuff she may not get at the medical exam:

1. some shots that are age appropriate for her and

2. a chest x-ray

and that's ok.

No worries there - usually the med crew code up the exam results in a particular way that the IV staff know how to respond to - and

usually the response is a particular coding in the K-1 visa

but even then - that coding just means - can't take certain shots or chest x-ray - Medical Waiver Granted with some special code in the visa.

In the end, when she goes in for a medical in the USA, as part of the I-693, the civil surgeon is supposed to interpret that coding in the visa, and finish up with the remainder of 'the stuff' she missed in Mexico,

and

her medical file will be marked complete with the extra stuff done in the USA,

and

it's up to the two of you to chase this down, in real time, with the civil surgeon. YOU DO NOT want to get an RFE for this stuff AFTER the AOS packet it submitted, so pay attention, just a bit. Usually, it suffices to ask the civil surgeon in the USA to 'bring her current now that the pregnancy is completed'...
