Hello, I am just looking for some guidance, as I am confused where to go from here. I received noticed in the mail that my petition had expired back in January I believe. I was currently working on collecting the forms that I needed for the checklist after receiving my NOA2. Does this mean that I need to start again from step one, paying the filing fee over again and resubmitting the I-129F?

That seems strange, like you missed an earlier communication possibly -- it shouldn't just expire on its own. When did you file the original petition? Did you receive anything from USCIS before this, such as an RFE notice (request for more evidence)? I am not sure, but I think petitions only expire if you do not respond to an RFE within 90 days, OR if you have moved and your mail gets returned as "undeliverable". Please tell a little more details about the timeline of your case?

POE San Diego, September 13, 2013, Wedding October 25, 2013

AOS filed November 19, 2013, EAD/AP received January 30, 2014, interview and AOS Approval on February 27, 2014.

ROC filed December 3, 2015, NOA1 12/4/15, Biometrics 12/31/15, ROC Approval on June 16, 2016, 10-Year Green Card received June 22, 2016.

N400 filed September 14, 2023, same day acceptance and Biometric Reuse notice, Interview on 2/13/24: Passed and same day oath. ALL DONE WITH USCIS.

No RFE at any stage, thanks to VisaJourney!

That is true, everything that Lynkali said is correct. Even on the Final NOA2 that i received there is a validation date on there. For me it has it from the day my petition was approved till another date. validation 4/11/13 to 8/10/13.

I had filed the petition last year in March. It was approved on September 26, 2012. I received notice in the mail that my petition expired in January, I had yet to send in any of the required forms after receiving the NOA2. I threw out the notice they sent me. I am sorry, I do not have an detailed information on dates. My fiance and I had decided to not get married at the time, so I did not act on the NOA2. But now that I am back in Canada, we have reconsidered our decision. So now that it is expired, I have had trouble finding out if I need to start again from step one and refile everything, or if I should contact USCIS?

Ack. Well, I'm sorry to say that yes, you have to start all over. Why did you not revoke the petition when you decided not to marry?

And why in the world would anyone "throw out" the NOA2 after paying hundreds of dollars and waiting many months for an approval? Most of us here are waiting on pins and needles for the NOA2, checking obsessively and hoping and dying for a response ... I plan to practically KISS that NOA2 when mine arrives. :D

No offense to you ... I just can't understand throwing it away or letting it expire.

But since you have no pending K-1 at this point, you do have to start over. I don't know if the lack of action on the previous K-1, or having filed for the same person in the past, will have any impact on your next one -- you'll need to research that as a different issue.

A USCIS-approved I-129F petition is valid for four months. However, had you contacted the Embassy, they would have extended the validity of your petition for another four months. All in all, they could have extended it for up to one year. Now you will have to start over from scratch.

Thank you for all the information. My reasoning for throwing out my NOA2 was that my fiance and I were going through a particularly rough time. He was diagnosed with Osteosarcoma, a form of bone cancer and resulted in him having his right leg amputated.

Times were rough emotionally and financially and I just could not focus on acquiring the Visa. But now that things have improved I will have to start over on the petition. Paying the filing fee again is not an issue to me, I just hope the expiration of my previous petition does not affect the filling of my future petition.
