Hello

I moved to the US less than a week ago on IR1 visa to join my USC wife and USC newborn child. Since my wife is on a maternity leave and I am not employed currently, we are seriously considering applying for Family Halth Plus, which is a public health insurance program here in New York State based on household income.

As I understand my USC wife and child are eligibile to receive the insurance benefit. However, it is not clear to me whether this is considered as mean's tested public benefit and if I (LPR) am eligible to receive it. Please share any experience or advice that you may have regarding the topic.

January 26, 2010 - got married
March 8, 2012 - became US citizen
April 16, 2012 - sent I-130 package
April 21, 2012 - NOA 1
Oct 2, 2012 - NOA 2

NVC:
Oct 10, 2012 - Received NVC case number and INN (by e-mail)
Oct 10, 2012 - Received AOS fee invoice (by e-mail)
Oct 11, 2012 - Sent DS-3032 (by e-mail)
Oct 12, 2012 - Paid AOS fee online
Oct 16, 2012 - Accepted DS-3032
Oct 18, 2012 - IV bill generated
Oct 18, 2012 - Paid IV fee online
Oct 22, 2012 - Mailed AOS package
Oct 22, 2012 - Mailed IV package
Nov 8, 2012 - Case complete at NVC (notified by phone)

Consulate:

Jan 29, 2013 - Visa interview

Apr 10, 2013 - Visa issued

03.04.2013 (Day 0) - Sent off I-130,I-485, I-765, I-131

03.06.2013 (Day 2) - Package received by USCIS Chicago

03.12.2013 (Day 8) - Received all 4 NOAs via text and email

03.13.2013 (Day 9) - Checks cashed

03.18.2013 (Day 14) - NOA hard copies received

03.21.2013 (Day 17) - Biometrics for I-485 and I-765 received

03.25.2013 (Day 21) - Walk in Biometrics Done (around 3pm)

04.02.2013 (Day 29) - Case Status Appeared & Updated: Testing & Interview

04.05.2013 (Day 32) - Biometrics Appointment NYC Varick St.

05.03.2013 (Day 60) - I-765 Case status appeared: Card Production

05.11.2013 (Day 68) - Employment Authorization Card in hand :)

06.06.2013 (Day 94) - Interview Scheduled for July 11. Via USCIS case status

06.08.2013 (Day 96) - NOA Initial Interview Hard Copy arrived in the mail

Thank you for the reply. What makes you think that it is not means tested and, therefore, ok for me to apply.

Thanks for the tool. The toolkit is not designed to determine immigrant eligibility. It just looks at other factors (i.e. income, child care). I have found some literature indicating the New York State Medicaid and Family Health Plus are not means-tested but I'd like to see a more credible source.

08/13/2012: Package received by Chicago Lockbox
08/14/2012: Priority Date
08/17/2012: Notice of receipt sent
08/21/2012: Biometrics appointment notice sent
08/27/2012: Walk-in biometrics completed
09/19/2012: Interview scheduled for October 26
10/24/2012: EAD production ordered
10/26/2012: Interview in San Antonio. AOS approved!
11/5/2012: USCIS claims green card delivered, nothing in mailbox.
12/5/2012: Service request filed for non-delivered green card.
12/7/2012: Service request replied to (but not delivered).
1/4/2013: Filed I-90, paid another $450
1/24/2013: Biometrics again...
4/1/2013: First Green Card from November finally arrived...

4/22/2013: Replacement Green Card arrived.

8/9/2014: Filed I-751

8/14/2014: Received NOA for I-751

3/12/2015: ROC Approved!
