First Post here. So, I'm getting married to a Brasilian(I'm an American). She currently has a job in Brasil but travels to the US on business(b1/b2 visa). I heard that if we get married in Brasil she can't leave that country for 6 months but if she gets married in the US she can't leave here for 6 months. What visa should she be looking to get and is it more advisable for us to get married there or here? I'm starting from scratch and realize these are probably basic questions. TIA.

It doesn't matter where you get married, she'll have to return to live in Brazil during the visa process. You should file an I-130 to chase a CR-1 visa, which takes somewhere around 10 months to get. Go to this link and read up.

She can leave her country and visit.

It would be a matter of attempting to get a visit visa if that is required for her to visit the USA from her country.

She would use her papers to prove she is going through the process legally and wants to visit during the paperworks processing.

Not everyone will be approved for a visit visa but it happens frequently and people still visit the USA during the process.

try reading the guides on this site

with a K1 you will petition her, once her petition is approved and the visa is issued, then you get married in the US and do an AOS

for a CR1, it does not matter where you get married, but she will return to brazil until her visa is issued, this one costs a little more up front, but comes with a GC so there are some benefits

as a note this is a very basic and simplistic answer of your question

in either case she can travel to the US while her visa is pending (there are forums on this site that discuss this) and she is not forced to stay in brazil for the duration

Not sure how much bureaucracy there is to marry a foreigner in the states, but I know ( from experience ) that here its a bit complicated. It took my husband and I about three months to get the paperwork ready for us to get married here ( It didn't help that he was born in Peru and we had to get paperwork from there too ).

I even joke sometimes, that the papers traveled more than I ever have in my lifetime... lol
