Is there a differences between the K3 and CR1 Visa both say that they are for your spouse visa and both require an adjustment in status. The reason I ask is I am applying for a IR1 visa because my wife and I will be married 2 years in Sept 2013 so we qualify to get that visa I believe and she will be PLR as soon as she gets here assuming it takes 6 or 7 months to process . But I am confused about something I read here . On this site where it says " How do I bring my child,son or daughter to live in the united states ? " The Note says The Children automatically qualify from the K2/K3 visa as derivative status of their mom's K2/K3 status (you need only petition for your fiance/wife and list the children on that petition in the relevant blanks. it does not say any thing the IR1 or CR1 and I think the CR1 and K3 visa is the same because both require to adjust your status.I have my wife's I-130, g325a and my 2 year 5month girl I-130 and G325a and my G325 already to send out this Wednesday and of course the marrage licence and birth cert and divorce from previous marrage and all have been translated to english . so is this petition of visa later and do i have to pay for a visa for the 2 year old can some explain if they understand what i am asking . Thank you

for a CR-2 or IR-2, an I-130 must be filed on the child.

fwiw, the I-130 is the petition.

the visa application, the ds-230, is something else, down the road, each visa applicant is allowed to file for an immigrant visa application IF the USCitizen's petition, the I-130 (on each) was approved.

The CR-2 and IR-2 are superior visa types, when comparing to K-4. I suggest you totally wipe the taste of K-3 and K-4 out of your mouth, spit it out as one of the bad tastes you've run across.

K3 = adjustment of status

CR1/IR1 = immediate green card - no adjustment of status.

IR1 is granted if the couple has been married for 2 years or more at Point of Entry. IR1 is a 10 year green card.

CR1 is a 2 year conditional green card that requires removal of conditions in 2 years after Point of Entry.

It will probably take longer than 6-7 months to process in total.

For an IR1/CR1 visa route, the children each need their own I-130 petition along with the $420 fee and appropriate documents.

Children do not need a G325a with their I-130.
