Has anyone used the intending immigrant's income to qualify? My income is short of 2k to qualify as a sponsor for my husband. He recently started working, can we use his income to make up for the shortage. If we can use his income, what needs to be sent in does he need anything from his boss (he has a workers permit). Thank you for your help.

The shortfall can be obtained from other household members, family sponsors or asset's you have. You need to fill out an i-864a form with your application!!

I am confused by your timeline. How could you have filed for AOS without providing the I-864 to begin with when you filed? At that point he would not have received his EAD yet, and therefore would have no income to use for the I-864. How and why was he able to receive the EAD without you sending in the I-864 with his I-485 already?

We sent every thing in last year. But we received an RFE they lost his medical exam and the I-864 and we have to send it again :angry: and now we realized that my income is short for 2000$

Well you could list his income at 24 (b), then check off 24 (e) - I'm not too sure if this is allowed / they'd count his income though.

That's what i thought but i'm not sure do we need to send anything else like a proof from his boss or the copies of his check stubs??

They lost the I-864 too? Wow. When you first sent the I-864 you were making enough on your own? Did your current pay rate reduce since then?

Usually you cannot include the foreign spouse's income because they are not allowed to have one yet at the time they file for AOS. Your situation is a bit different because they lost the first one and want another. He is working legally at present time, so I would go ahead and include it. You need to include proof the income will continue. Easy to do with a letter from his employer listing his salary and stating he has a permanent position that will continue once he becomes a permanent resident. If you have any assets, like money in savings that could make up for the shortcoming, I would list those too, just in case.

NO i make the same, we just did not pay attention i guess to the 125% i went with the 100% which i made above. But thank you very much for your help, it's highly appreciated.
