Hi everyone!

I have a question.

About a few years ago, my brother (US citizen) has decided to apply my permanent residence. Yes, he is the petitioner. It's processing and of course it's taking almost six years now. (I understand it takes a long time)

Now, I recently got engaged to US citizen and we are working on the paperwork.

I would like to proceed the paperwork with my fiance, not my brother's.

Do I need to cancel/drop the case of my brother's, being the petitioner? Two same documents will be processing...

Please advise!

No worries about the brother's petition, just have yer USCitizen Fiance(e ) file the I-129F and go forth.

OP: PLease stop posting all over the place, you will get answers that are wrong for you if you post in sections that do not apply to you as each visa process is different. Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you for your advise! I will look into the form.

oops - i've given you the wrong advice.

I had an opportunity recently to review all of your prior posts.

You wish to adjust status from an E visa to hold a green card as a permanent resident.

Finally, I understand.

You've a fiance somewhere, you need to marry her first then file the big AOS (Adjustment of Status) paperwork.

And yes, that means a NEW I-130. (plus all the rest of the forms, I-485, I-864, etc etc plus a medical exam)

so ...

although you'd have 2 I-130s in play, it's for two different things, with 2 different 'basis of filing' .

No need to worry about the first I-130 your brother has filed, as it's a different basis altogether.
