Hi,

I have filed Affidavit of Support with my income and my uncle's income as joint sponsor. Today I received a email back from NVC and they wanted proof that my Uncle is "really" my uncle. He does not have birth certificate so I can match that with my father to show he is as he fled Tibet during the Chinese invasion and they never had birth certificate when he lived in India (So he says). My father does though.

What I am thinking of doing is... providing them my father's Birth Certificate and My Birth Certificate (I think they have one already on filed when I filed I-130) and getting a statement from my father and my uncle stating that they are brother's. Would that suffice? Should I mail the original birth certificate or can I mail a copy?

Please help me with a solution.

I can't really help but I'm confused as to why they need proof that your co-sponsor is your uncle, as a co-sponsor can be anyone. doesn't have to be a relative. So weird.

I can't really help but I'm confused as to why they need proof that your co-sponsor is your uncle, as a co-sponsor can be anyone. doesn't have to be a relative. So weird.

Yea... This is what it says on page 3. household member would be my uncle and sponsor would be me as I am the petitioner..

required to complete the financial evidence review. Please provide all requested documents and
refer to page two for mailing instructions.

[x] The checklist below indicates missing or incomplete documents.
Supporting Documents Missing or Incomplete
[x] You as a household member have not provided proof of your relationship to the sponsor.

Let's say I get the proof and they want me to resubmit the forms. Do I need to reattach evidence that they already have such as Tax information, Proof of Employment, etc? I just reviewed the checklist and no where does it say anything about providing proof of relations...

Did I fill out the wrong form? I filed I-864 and My Uncle filed I-864A. To me, he fits the definition of "Household member" as we both reside in the same house address....

yes, if you live in the same house, he was supposed to fill out the I-864A....so that is correct. I guess that is also why they want to see proof of relationship.

You should only have to submit what they ask you for, which is proof of relationship. I would do as you stated which is show all birth certificates that would help and also get notarized letters from your uncle and dad. Is your grandmother (their mother) still alive? a letter from her would be good, too. ummmm....I will try to think of other ways you could prove it as well. hopefully someone else will come along with a brilliant idea in the meantime.

Thanks, Kazulie for replying especially at this hour. I think I will just file I-864 and have my uncle sign as Joint Sponsor rather than Household Member. It says that Joint Sponsor does not have to relate to the sponsor or immigrant so I think this might be my best option. I am just going to get the form filled and ready for mailing and will check back before mailing to see if this is a good idea. Would you think I need to send all the proof such as employment again for my uncle if he is switching form from I-864A to I-864?

It says that Joint Sponsor does not have to relate to the sponsor or immigrant so I think this might be my best option. I am just going to get the form filled and ready for mailing and will check back before mailing to see if this is a good idea. I think I have filled the wrong application. My uncle was suppose to file I-864 as Joint sponsor as he does NOT meet the definition of "household member". Here are reasons why i think so:

I-864A definition for "household member" is:

A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;

Since he is my Uncle, I guess he doesn't fit this even though we have same principal residence.

A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor;

Does not meet either because he isn't claimed as dependent on my federal income tax return.

So I guess I should have been more thorough when I first filed these.... It looks like I may have gotten answer to my own question... Does that sound right?

Yes, it would be a joint sponsor not household member, if you do not combine incomes or claim a dependency status.

If your uncle has sufficient income for his own household plus your spouse, you should each provide an I-864 instead. You cannot combine income with an uncle whether you live in the same household or not. You can only combine income with a parent, adult child or sibling.

See "How do I count household size?" on page two of the I-864 instructions.

No you have it correct. Two I-864 forms, then provide evidence your uncle is a US Citizen or Green Card holder.
