Hi Vj'rs

Hope someone can answer this for me..On form DS-230 (Application for Immigrant visa) there is this question #31b stating: List the Person(s) name who will follow you to the United states at a later date? My husband had listed his 3 children from previous marriage..is that right? although I am only petitioning my husband and not his 3kids. He will be the one petitioning them later in years to come. I'm just scared that, by him putting his 3kids name in that question will be added to the number of people as my dependent on the I-864 (Affidavit of support)I need to submit.And Instead of just having enough income for 2 people requirement, now it will be for 5people? Can someone please help :bonk:

You should only name your husband, not the 3 kids. He will do that later when he files his own petition for them.

The DS-230 is filled up by the beneficiary, not the petitioner. The husband did the right thing by listing his children and for them to follow at a later date (when he files for them). Listing the children doesn't mean that they are included in the current petition. They don't qualify as derivatives either, as derivatives are NOT allowed in the IR/CR categories.

Thank you so much for clarifying that out for me...mind if I asked another question, when submitting DS-230,its asking for original or certified copy of birth certificate and marriage license, can we submit the one we got from the NSO (national statistic office)?

Yes, submit your husband's original NSO birth certificate and your original NSO marriage certificate.

Yes, submit your husband's original NSO birth certificate and your original NSO marriage certificate.
