Couple facing charges after 'overt sexual activity' on plane

RALEIGH, N.C. - A California couple are facing federal charges after they refused to stop "overt sexual activity" during a flight to Raleigh, authorities said.

Carl Warren Persing of Lakewood, Calif., and Dawn Elizabeth Sewell of Huntington Beach, Calif., were indicted on charges of interfering with flight crew members stemming from their Sept. 15 Southwest Airlines flight from Los Angeles with a stop in Phoenix. They face a Dec. 11 trial date in U.S. District Court in Wilmington.

According to court documents, flight attendants saw Persing and Sewell kissing, embracing and "acting in a manner that made other passengers uncomfortable" while the plane was stopped in Phoenix. Persing was observed kissing Sewell near her breast and was also observed with his face pressed against Sewell's lower body.

A flight attendant asked them to stop. They obeyed initially but resumed the behavior during the flight from Phoenix to Raleigh.

When the flight attendant again requested them to stop, Persing allegedly told the flight attendant: "I'm going to give you one warning to get out of my face."

Persing and Sewell continued the verbal harassment after a flight attendant refused to serve Persing alcohol, according to court documents.

Law enforcement officials were waiting for the couple when they arrived at Raleigh-Durham International Airport.

RALEIGH, N.C. — A man who federal authorities said engaged in "overt sexual activity" on a flight to Raleigh actually was just not feeling well, his attorney said Tuesday.

Raleigh lawyer Deb Newton said her client, Carl Warren Persing, laid his head on his girlfriend's lap because he was drowsy. The gesture was misinterpreted by a flight attendant, who then humiliated and harassed the couple, Newton said.

Persing and Dawn Elizabeth Sewell, both of Lakewood, Calif., are charged in federal court with interfering with flight crew members stemming from their Sept. 15 Southwest Airlines flight from Los Angeles with a stop in Phoenix.

Law enforcement officials were waiting for the couple when they arrived at Raleigh-Durham International Airport. The couple spent three days in jail, Newton said.

When a flight attendant asked the couple to stop their public displays of affection, they initially obeyed but resumed the behavior shortly thereafter, court documents state.

"The one witness I've talked to and the defendant dispute almost everything in the government's affidavit as to what happened on that airplane," Newton said.

She said she will ask that the charges be dismissed. Persing's trial was delayed until February.

Newton also said Persing suffers from a chronic disease that requires medication that makes him drowsy, dizzy and irritable. She declined to identify the disease to protect her client's privacy.

I think the airlines should provide a conjugal room for long flights. Passengers who want to use it would pay extra. Of course then it would take some of the thrill out of it. :P

it's called the bathroom. The newer 777s have a very large (by airplane standards) bathroom on board.

RALEIGH, North Carolina (AP) -- A man arrested for allegedly engaging in "overt sexual activity" with his girlfriend on an airliner was lying with his head on her lap because he wasn't feeling well, his attorney said.

That gesture was misinterpreted by a flight attendant, who humiliated and harassed the couple, said attorney Deb Newton, who represents Carl Persing.

Persing and Dawn Sewell, both of Lakewood, California, face federal charges of interfering with flight crew members, allegedly by disobeying a flight attendant's request that they stop their public displays of affection.

They were arrested on September 15 when they arrived at Raleigh-Durham International Airport on a Southwest Airlines flight from Los Angeles.

"The one witness I've talked to and the defendant dispute almost everything in the government's affidavit as to what happened on that airplane," Newton said.

She said Persing suffers from a chronic disease requiring medication that makes him drowsy, dizzy and irritable. She would not identify the disease to protect her client's privacy.

Sewell's lawyer did not immediately return a call seeking comment.
