Hi good people of VJ, as the topic subject states my situation is as follows;

First off, I came to the US on F1 visa which has long expired, I have been married for two years and we are putting together the AOS packet looking forward to mail it in the next month or so.

I lost my I-94 due to some carelessness, the card was stapled onto my passport (expired) but for some odd reasons my ex girlfriend thought it was safe to detach it and keep it safely unfortunately we broke up and upon moving out I left some of my stuff at the shared place when I requested to have my important documents she said she had discarded them and whatnot. So I filed a police report for a lost passport but I never mentioned the I-94. I have a police report with me.

A year later she mailed me saying she found my expired passport but no I-94 and she doesn't know where it was.

Succinctly put, I-130 question 14 asks for Arrival/Departure record as well as expiration date, I don't have that information so my questions are;

1. On question 14 of form I-130 does my spouse leave it blank and provide the police report and copy of the visa and immigration stamp when I arrived and provide information on what happened?

2. If I filed form I-102 concurrently with AOS will it have any effect on either process? Since I read somewhere that the I-94 process takes at least 2.5 months

3. Somebody mentioned that my former school or social security office might have the copy or number of my I-94 number in file, as anybody ever experienced anything like this?

I have contacted my old school and requested them to check, will contact the local social security office in the morning.

Any answer, suggestion is highly appreciated.

On the side note good luck to everyone who is waiting on their cases.

You need I-94 or a stamp in your passport. Did you get the old passport? That was not clear in your post.

If you get a RFE for the I-94 there is a time limit for you to respond, or they deny your application. If your I-102 is not finished by then, then your AOS would be denied. I would file the I-102 first.

Moved from AOS from family based visas to AOS from work, student, tourist as the OP is not adjusting from a family based visa but a F-1 visa.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

My bad, I will have to edit that. Yes I received my old passport, she mailed it. I have a stamp and shows the date of entry and point of entry.

You still need the I94 regardless of having passport, unfortunately. It's your proof of having entered with inspection, and one of your primary evidence of being eligible for AOS. So you'll need a replacement. It can take a while though. I'd suggest filing form i102 soon - before AOS.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

Thanks for the helpful suggestions at this juncture we have decided to start filing the i-102 and i-130 and send them hopefully by Monday.

Can any one help me, on i-102 part one question 10 through 12 (see attached pic below) it asks;

10. What is your current Nonimmigrant status?

11. Status expires?

12. Provide your form I-94, i-94W or i-95 Arrival-Departure number?

My status has expired but on the drop down menu there isn't that choice, do i leave and the rest of the questions blank and provide supporting documents like police report, copy of visa and entry stamp, date and POE?post-155376-0-01766200-1363314779_thumb.jpg
