Hi All,

Just wonndering if you would be able to shed light on this.

We're just about to file documents to adjust status. Our lawyer requires us to make a check in the amount of $1070 and $420.

Talking with a fellow VJer, they mentioned that if all the documents were filed at the same time, the $420 was waived?

Can someone please explain - obviously don't want to spend an extra $420 if we can avoid it.

16 Oct 2012 - Packet 3 received

18 Oct 2012 - Sent DS-230 off to Sydney Consulate

01 Nov 2012 - Medical completed

07 Nov 2012 - Packet 3 Sent to Consulate

08 Nov 2012 - Packet 3 Delivered

15 Nov 2012 - Packet 4 Received

18 Dec 2012 - Interview APPROVED!

28 Dec 2012 - Entered USA POE:- LAX

09 Jan 2013 - Married

Typically, the 420 is for the I-130.

Did you come in on a K-1 visa? and marry within 90 days of POE date?

If so - you not need the I-130 at all, so no need to include the fee for the I-130 if you are not filing it.

If the attorney is telling you to file an I-130, and IF you got married in the USA within 90 days of the POE date,

I'd say you have a very stupid lawyer.

If your lawyer wants to file I-130 fire him/her immediately!

Read part 2 on the I-485, you are choice C, NOT choice A. You file AOS based on the approved I-129F and subsequent marriage to the petitioner within 90 days of entering the US. I-130 is not required!
