I have a question about how to fill out the I-864 for my co-sponsor.

Background: I don't have a job. I am the petitioner for my husband, and Australian citizen. He had his interview on Feb 19th, and we got a 221g for my co-sponsor's I-864, saying that it was not filled out correctly.

Since I do not have a job, and we do not have any savings to speak of, we are relying on my mother's (our co-sponsor) savings to cover us, which is no a problem. We are going to be living with her for a few months. I did include her on my form, so on MY form we have a household size of 3.

Problem: On question 21g it says: OPTIONAL: If you have siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting Form I-864A, enter the number here.

I'm not sure what to put for this question on my mother's (co-sponsor) form. I don't have an income, so I would think that I'd put 00 here, making the household size 02 on my mom's form. BUT on my form, I had the household size as 03, and the interviewer had no problems with my form.

This may have a simple answer, but I just can't see it as I am stressed beyond belief with this whole thing. Why even say we have an interview if the forms were not filled out correctly in the first place. It such a waste of time and money for us. (end rant) :angry::bonk::crying:

Provide new forms, one for you and one for your mother. Both will be I-864. Do NOT count yourself in your mother's household and do NOT combine income. Your joint sponsor will need to qualify for their own household size plus the intending immigrant. You are not part of your mother's household. You are a married adult US Citizen. If your mother's income alone is sufficient, she need not list or document any assets. Only liquid assets are going to be counted anyway, not things like equity in her primary residence.

I don't count myself in my mother's household even though we are going to be living with her?

Edit: I should also say that my mother's house is what I put on all the forms as my principal residence.

No you do not include yourself. Household doesn't mean people who live in the house. Household is the people within a family. Unmarried, 21 and under children, spouses, immigrants (intending and here) as well as any dependents.

This is from the I-864 instructions regarding household size:

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ affidavit of support whom you are still obligated to support. If necessary to meet the income requirements to be a sponsor, you may include additional relatives (adult children, parents, or siblings) as part of your household size as long as they have the same principle residence as you and promise to use their income and resources in support of the intending immigrant(s).

I did this on my form, included my mother. So what I need to do is... what? Fill out a whole new form of myself, only including myself and my husband, as we have no children. Then have my mother fill out a new I-864 and have her include herself and my husband as her household size?

Yes that's what you do... You each need just an I-1864. That's it. They mean if your mom was married, her spouse could include an I-864a and add their income to hers to help meet the guideline.

Ok, thanks! Sorry for all the questions, and the confirming.

I do have one more question, do I need to resubmit all of the evidance that I did with the first set of I-864s or will they look at it from the pack the interviewer had?

Neither you or your mother are COMBINING income to qualify. She needs to qualify on her own. Do you even have any income to combine? Anyway the two keywords in what you made bold are "may" and "combine". Don't interpret may as must and don't ignore combine.

Neither you or your mother are COMBINING income to qualify. She needs to qualify on her own. Do you even have any income to combine? Anyway the two keywords in what you made bold are "may" and "combine". Don't interpret may as must and don't ignore combine.

Yes, I see that now. I was really "freaking" out earlier. Thanks for explaining it to me. :D I am going to mail our forms back to them on Monday.
