ok my wife is an the intending immigrant along with my two children, and then you add me which makes 4 right? but on the I-864 since the AOS is for my wife, she takes 1 point for being the person i am sponsoring plus another point for being my wife. my question is, do I put zero on one of these boxes so i dont count her double? and if so, which box do I put zero on, is it PART 5 ITEM NUMBER 1? or PART 5 ITEM NUMBER 3?

also i applied separate petitions for my wife and 2 kids, so i received 3 invoices for $120.00 each. when i paid for one of them, it started processing but when i went to pay for another one, it wouldnt let me. im just trying to make sure because i will be filing for exemption on their affidavit of support. does this mean i only pay for one fee?

You only pay the fee once for all three.

You count your wife only once; either as your wife or the intending immigrant. Put zero in either the spot for wife or intending immigrant.

Actually, the spouse being the intending immigrant is counted as the intending immigrant. The way you follow the instruction not to count anyone twice is to leave the box next to spouse blank. It's not either or. She is counted as the intending immigrant. She is the only intending immigrant listed on the I-864. Since there cannot be zero intending immigrants, leave the spouse box blank and 1 in the intending immigrants box.

You must read carefully and follow ALL instructions. One instruction is not to list anybody as an intending immigrant on the I-864, if they are being petitioned with their own petition. So, for wife's affidavit, children are just counted as dependents, not listed as intending immigrants. Since THESE children will have I-864W forms filed for them, they will never appear as an intending immigrant on ANY I-864.

do you know where i can get the DS-260? i have already filled up all AOS forms and all supporting documents. Do I send these documents first or do i include the DS-260 along with it? because I went to the website where i log in and see the fees and such but i cant seem to find where to fill up a DS-260 anywhere. I have paid the AOS fee but not the IV fee yet.

The DS-260 is an online form that won't be made available until after you are able to and subsequently pay the IV fee.

AOS and IV documents can be sent together in one package regardless of whether the IV fee has been paid or not.

Your Iv fee and ds 260 will not show up untill your Ds-261 has been review and invoice. You can call the NVC And have them do it on the phone

You can and should sent in the AOS and Iv Packets together now . You do not need the DS-260 for that. Just be sure to send in a document cover sheet. I use the one that you can print after you paid your AO S fee there is a address on the cover sheet.Or you can use the one that came with the welcome letter. Whichever one you use send both packets together
