Will having a domestic violence misdemeanor one, knowingly caused or attempted to cause bodily harm on my record with marijuana paraphernalia charge be grounds for denial of 129f petition? Both records are over 3 years old. My fiance the beneficiary has no record. Although I have done a state wide search for a record of the drug charge it does not come up on reports, besides it’s only one charge the instuctions on the 129f clearly states 3 or more convictions so if I only have this one conviction with drugs a certified backround check is not required on one charge but three or more is this correct?

I don't know too much about that, but you might be better off posting in the K1 forums as the Canadian forums as awesome as they are don't get too much traffic.

You need to get the certified copy of the court case with the disposition as well as something from the police for the domestic. It will be brought up to the beneficiary at interview. Mine was 12 years old. It will not cause a deniaal, but id u don't include the documents you will get an rfe.

06/10/2015-Went to info pass appt. Hubby got a 1yr. Extension stamp in his passport and biometrics done

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.

No, you will have to disclose the court decision along with your i-129f. Make sure fiancee knows about this because they could ask her at interview. don't sweat it. I had similar scenario when I filed.

If your fiance is the Canadian who is coming to the states (you mention he/she is the beneficiary)I don't think you have a problem. They're asking for the Canadian to get a background check, not the American.

but perhaps that process has changed?

The Marijuana charge wont mean anything. It needs to be 3 or more as the I-129F states so you don't need to worry about that. I'm not sure about the domestic violence conviction.
