I am married to a US Citizen al eligible to apply for the naturalization. The requirements mention I need to be physically in the US for the last 18 months prior to the application. My son is 17 months old and I also want him to apply for the neutralization. What is the process for applying for his naturalization? Does he need to be physically in the US for 18 months as well?

No he doesnt need to be in US, u can just apply for CRBA (Consular Report of Birth

Abroad) he is automatically will be given a citizenship base on having a US Citizen parent... u'll have to call and asked the Us embassy for more information, this is what i did for my daughter a year ago.

oh wait is your son 17 months old or 17 years old? and is your US citizen spouse the biological parent of your son? if not then u have to go to a regular processing of naturalization...

Is your (presumably 17 YEARS old) son in the USA with you as a greencard holder?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

A CRBA can only be filed if one parent is a US citizen at the time of child's birth.

The OP has not naturalized and we do know if the other biological parent was a US citizen at the time of birth.

Is your son 17 months old or a teen? You are giving conflicting information.

Only green card holders over 18 years old can apply for naturalization. Those under 18 years old cannot apply for naturalization.

A child under age 18 with a green card living with you when you naturalize automatically becomes a US citizen under the Child Citizenship Act. Since its automatic, nothing needs to be filed.

The child's time outside the US does not matter.

Does your child have a green card?

Does your child live with you?

Will your child be under 18 years old when you take the oath of US citizenship? When will your child turn 18?

Apologies. I just realized the context of my question was not complete clear.

Let me try again...

I am married to a US Citizen and moved to the US since 2008. My son is 17 years old and both of us are green card holders since 2011. At the moment I meet all the requirements to apply for the US Citizenship as my wife is a US Citizen. I found that one of the requirements is to be physically in the country during the last 18 months prior to the application. As my son is planning to travel out of the country for a few weeks; my questions are: Is he required to be physically in the country for the 18 months prior to the application? The information I have found describe the spouse requirements; but not specifically for my son; therefore, what is the process for my son to apply for US Citizenship? Is his application sent jointly with mine?

If your son or anyone, is out of the country for a few weeks, then no, that does not break continuous residence. So as long as he's met the other criteria for spending the necessary amount of time in the US then that should be fine.

If you receive your citizenship BEFORE your sons 18th birthday then he automatically becomes a citizen. If he's 18 or older, then he will have to apply on his own and under the 5-year rule.

Just to make sure, you, as the spouse of a USC whom you gained entry through, are eligible to file for citizenship 3 years minus 90 days from the 'resident since' date on your green card (which is the same date on both your conditional and 10-year green card).
