I have 3 DUIs on my record and just sent my CR-1 packet to the USCIS and used "Rapid Visa" to help with process. They sent me a cover letter to include my court documents concerning these DUIs. But I did not have them and sent it anyway. Is this a problem? I thought that this only was for K-1 cases only??? At least that was what I had read on here. Any help? Thanks guys.

Assuming that you are a USC you can go to your local county police department and request a copy of your criminal history report. This is what I did and that was all the USCIS needed. I also have DUIs like yourself and it was not an issue. The only thing that happened was the CO officer interviewing my gal made a BIG point of letting her know about my criminal report. The fact that you must have included the DUIs on your petition has created questions for the USCIS that need to be answered and they need to see a criminal history report.

You filed a K-1. Yes you are required to obtain the court documents for your petition. I am NOT filing the K-1 I am CR-1. My assumption is that the court documents are not needed for USCIS. Thank you for your input.

Hi. If they requested them specifically then maybe they do need them.. Just give them what they ask for, like that they won't have a reason to delay your application. I don't think that it will cause any problems, the DUIs, for you as the USC. But they do need to investigate. Good LUck

Regarding this question, the rules are the same for both types of petitions. If you will reread, the question was the same for both types of petitions and the needed information requested by the USCIS for both types of petitions are the same. You are welcome...

Please forgive me for trying to offer information, based on my personal experience. Yes, the timeline would probably have avoided any post from me.

Yes, they stated that rapid visa sent the cover letter.

Not USCIS.

While I have absolutely no personal experience in this dept, this would be my best guess to the whole situation.

• It doesn't state for you to include this documents in the instructions

• They run your name through various sources when deciding if to approve your petition

• I would think if they wanted the stuff after the name check, they would send you an RFE

If you are filing an I-130 for a CR-1, you can have 20 DUIs. It doesn't matter. Only time DUIs come into play is when you are filing an I-129F (K-1/K-3) and you have 3 more drug or alcohol related convictions. This is part of IMBRA and is there to inform the beneficiary of your past history. IMBRA does NOT apply to CR-1/IR-1 visas.

However, the Adam Walsh Act does apply to CR-1/IR-1 visas. I believe the AWA concerns things like crimes against children and women etc. etc. It does not have anything to do with DWIs.

I gave you the answer. The answer is no. You don't even need to mention it. In fact there is nowhere on the I-130 where it even asks.

Evidently Rapid Visa wasn't paying attention. There is no need to include anything regarding the US citizen's criminal record when filing an I-130 unless the convictions are related to the Adam Walsh Act. If you have such convictions, you'll need an attorney to have even the slimmest of chances of approval anyway. DUI/DWI convictions are only an issue in a K1 case and then only if there are three or more.

Facts are cheap...knowing how to use them is precious...

Karee, thank you. That is what I thought also. Just trying my best to get thus correct. If I needed them I would get them ready and send them. But they are not needed. Again thank you.
