I-864 Question: Annual Income

Hi All,

Maybe this is a dumb question, but I'd rather ask what seems to be a stupid question than tie up our application for weeks. I went back to work at the beginning of the year (it's something I can do remotely, which is a blessing). I made enough in 2009 and 2010 to cover the 125% requirement. I didn't in 2011, barely, but we have liquid assets enough to cover the 3x necessary to make that all right as well. My question is this: for current income, do I list my salary as the current income, or do I have to take the figure from my paycheck that is what I ACTUALLY take home and figure what my annual income will be from that? I've read the instructions, and they're not clear. I may just be making this more difficult than it actually is, but I'd rather be safe than sorry. Thanks! :blush:

They're asking for gross income, so if you have an annual salary, that's your current income. Current income is how you qualify, even though they ask about the past. Be sure to document your current income with a copy of a recent pay stub.

wait i thought for question 23 current individual income you put the number from your last taxes. this is wrong? i haven't snet mine in yet. i don't have a current income since i am living out of country with no work visa. my parents are joint-sponsoring and both self employed so no pay stubs. but i am submitting the last 3 years of taxes for them and me, is this ok?

That is correct only for the self employed. For the "employed", tax returns reflect past income. There's a separate section for that.

They're asking for gross income, so if you have an annual salary, that's your current income. Current income is how you qualify, even though they ask about the past. Be sure to document your current income with a copy of a recent pay stub.

May I tag on?

I put 22 percent of my salary into my 401K. Therefore my Form 1040 Adjusted Gross Income is roughly 75 percent of my actual annual income. I would qualify quite nicely even on the AGI figure, but now I'm confused about which figure to actually use.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

May I tag on?

Line 22 is the number you use from the 1040 form. AGI is only used when you file the 1040EZ.

so on my i-1864 i should write 0 for current income, but then i can show them my 2012 taxes and a letter form my american employer stating i have work on my return to the states. sound good?

If you have no current income, then 0 is the number but you won't qualify based on an offer of new employment. There's now question about what your income is agreed to be sometime in the future.

Just curious, looking at your sig timeline you've been moving through the process nice and quickly. I'm starting to get fairly worried about how long mine is taking, the USCIS phase was completed in mid-February and I still have yet to recieve any response to the DS-3032 and get the AOS bill and package.

Did you email or post (or both) your DS-3032?

You cannot send the ds-3032 without the case numbers. It looks like you have done that? Please call the NVC and find out your case numbers. There is a payment portal online to which you pay your invoices. But you need those case numbers. Unless you call you cannot give the NVC your emails so you won't receive any updates via email and everything will be physically mailed.

Go to the April 2013 NVC filers thread and read there first two pages and all the links except the ones dealing with electronic processing and online forms since they are not available for Ireland.

Thanks for your reply. I hadn't my signature fully up-to-date, I have gotten an NVC case no. about 10 days ago via email, with instructions about submitting the DS-3032 electronically.

I'm back waiting again now, hoping for confirmation of receipt of the DS-3032, and the arrival of my AOS package. So I have my case no but no IIN yet, so I can't pay the fee online.

I'm reading the the April 2013 filers thread now and I think I should call the NVC if I don't get any emails confirmation from the DS-3032 (6 working days since I sent it).

Stay on top of the NVC via calling. It's the best method to find out what's going on in your case. I find that after I call, they suddenly seem to send me emails. LOL like "omg she checked up on us! GAH!"
