Divorce Decree

I have a question with refence to the divorce decree for the I-129F. We are waiting for my fiance's divorce decree to come from his attorney. She was going to fax me a copy of the certified copy. Is it ok to send in just the photocopy of the certified copy? The reason she was going to fax this is because in Canada there is this 30-day cooling off period after the divorce (whatever....its been 1 1/2 years). We wanted to start the visa before the 30 days was up but wouldn't receive the original certified copy until after the 30 days.

Yes, you can send the photocopy of the divorce papers along with the I-129F. You will need the original for the interview.

If you are talking about the one you sent on the I-129F package, that one is a copy but you need to have the original to sent to your beneficiary for the interview.

Definitely send just a copy of the divorce decree with the I-129F. But you will need the certified original (and a copy) for the interview. They can look at the certified original and if they want a copy, you'll already have it ready for them.

I know from getting a RFI after sending my I-129 in with just a copy that you need a certified copy. I think some get through the service centers with copies but its up to the person reviewing the papers on what they want to see. So its better to cover you butt with a certified copy just incase. The RFI that we received cost us about 6 weeks. Good luck!
