My mother is a green card holder. She petitioned my sister who is below 21. I am looking at the affidavit of support form. How do I count her household size? She is married but her husband is in the Philippines and she filed married filling separately in her tax return. She doesn't have any dependents. In the form, it ask there, put 1 if you are married . So is her household size 3( herself, husband and petitioned sister/intending immigrant) she is married even though her husband is not here in the US?

Everyone here has lives outside VJ, you need to give it longer than an hour...

I would say the husband still counts, unles they are legally separated, as she (presumably) would financially support him if something happened, may send money to him etc.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Anybody has same case like this, like married greencard holder petitioning somebody ??? Pls help

Timeline

The husband counts.

If she doesn't want to count him, then she can end the marriage legally with a divorce or annulment.

Since she has chosen not to end her marriage legally, she must include him in her household count.
