I searched the K1 forums and could find the answers...

So many questions! I just received my W2 and my income is JUST barely shy of the 125% guideline for a family of 5.

1. If I have a Court Order for a substantial amount of child support that puts my income far above where it needs to be. Can I count that at income? I can't always show where it has been deposited into my bank account because its sometimes paid in cash and then just used directly to pay bills. If I can Count it with the Court Order as proof, then I'm all set. If not...

2. I can put enough in savings to cover the difference X 5, but does it matter that I am JUST now putting it in? Does it have to have been there for a while or anything like that?

3. Suppose we have more than enough to cover the difference in savings. We apply for AOS immediately when the beneficiary arrives, having plenty in savings to meet I-864 requirements. How long must that money remain in savings? We's like to use it for a DP on a home, but must it remain in savings until... AOS is approved?

I had to show proof that the child support was being deposited, the court order was not enough because it doesn't prove the money was physically received by you. I would recommend that you have your ex pay with a check from now on. Yes it does matter when the money was deposited into savings. They will want to know where and how all of a sudden you got that kind of money on such short notice. Not sure how long the money needs to remain in the account, maybe someone else will chime in. Is a co-sponser completely out of the question? Don't mean to dodge your question but it seems a little cleaner.

I could ask my Father. I just really reeeallly was hoping to be able to do it myself. If I asked my Father, he would have to be able to show proof of income enough to support his household of 3 as well as our 5, correct?

No. The co-sponsor needs to meet the requirement for their own household size plus the beneficiary.
