Hi Everyone,

This pretty much is out of the norm, but figured I'd post the question here. I tried searching for an answer through google but this seems to be a unique situation. Has anyone ever experienced or know what effect a claim/tip placed with ICE or Department of Homeland security has on the processing of a filed petition for K1 visa?

Here's the story. My ex (whom I have a filed order of protection against) claims to have contacted these departments reporting my fiance's name. He did not elobrate as to what he reported, but my fear is he has made an accusation that my fiance is fraudulently trying to enter the country. My ex works in the legal system so I know he has the capacity to cause such a problem. It really is embarrassing to me because i can't believe I ever spent any time of my life with this person. Anyhow, my fiance is aware of this situation. I'm just worried that this may cause delays with the processing of my I-129F or K1 on his end. The relationship I have with my fiance is bonafide. We love each other very much. I have visit him every 3 months and we speak to each other every day sometimes 3-4 times a day. We have met the test of meeting in person within the last 2 years.

Has anyone ever had an experience similar to mines, or atleast experience claims of fraud to ICE/Dept of Homeland Security? Or does anyone know what effect a claim like this would have for our petition. I know there may be an RFE, but what kind of informaiton would they ask. Should I file a copy of the order of proctection against my ex now or wait?

A report from an ex doesn't carry much weight. And because the relationship between you two, if he tries to dabble too much he could be putting his law license at risk as members of the bar are held to a high standard of ethics, and there is clearly a conflict of interest if he tries anything stupid. I would say there is nothing to worry about. Just keep all of your correspondence with him (emails, letter, texts, etc.) and there shouldn't be a problem.

You don't need to file anything in regards to your ex. This petition has nothing to do with him. If it comes up, then show them.

05/03/2022: Status changed to "The U.S. Department of State approved your application for your passport book. We're now printing your passport book and preparing to give it to you. You should receive your passport book on or around 05/09/2022."

05/05/2022: Passport Received.

05/09/2022: SSA Citizenship Status Updated.

05/25/2022: Naturalization Certificate received in mail.

If nothing to investigate than there is nothing to be worried about. ICE don't investigae frivolously cases.

the letter "t" is stuck, so if a word is missing it's "t", just insert it as you read.

How exactly do you know your ex filed such reports? Did he tell you? tell someone else? You are aware that if you have a restraining order it prevents him from harassing you directly or indirectly arent you? Filing a false report to attempt to prevent your fiances petition from being approved is indirect harassment and you should consider reporting it.

He sent it in a text. You are correct, it is indirect harassment. I'm not sure if he did file, but the way he is acting I can't disregard.

I just felt a worried because its approaching five months since I've filed and I wouln't want any uncessary delays. Especially since Jamaica is already classified as a high fraud country. Either way as bs058 recommended, I will keep the copy of his text and when we are due back in court I will have the opportunity to make this order permanent and never have to deal with him. This immigration process is complicated enough without having to deal with idiots.

It's a good idea to keep as much documentation of your communications with him as possible. :thumbs:
