If you don't want to send in the fee for the I-130 Support form is that ok ? We are going for K-3 instead of CR-1 And I am thinking it would be a waste of money to send the fee as it is a non refundable fee

You need to send that fee, The K-3 is a modified CR-1 visa, and as such the fees for the I-130 need to be paid. The I-129F alone is only a fiance visa application and is used for unmarried couples.

You don't need to send the fee, if you are abandoning the I-130 and going for the K-3 visa.

Well, you can't apply for K-3 until you have a receipt notice which is NOA 1 or I-797 Notice of Action FOR YOUR I-130. You have to attach a copy of that. You can't apply for K-3 without a pending I-130 and I-130 can't become pending until you pay the fees.

you don't have to pay the fees for the I-130/CR1 until after you get the NOA2..... after you get the NOA2, your case gets sent to the NVC where they send you the bill for the fees....

so the OP, if he/she wanted would not have to pay the fees and could just continue with the K3.....

this is just my humble opinion, take it or leave it...

Based on your timeline your I-130 and I-129f has been approved. So if you want to continue the CR/IR route then you will need to pay the fees. However, if you decided to go the K3 route then nothing is due now but once your SO arrives here in the states you will need to do the AOS and then the fees will be required to continue. It really depends on what you next step is, you have to make a decision.

Point of clarification: I-864 is associated with immigration in general and not I-130 specifically. It is also needed for situations where I-130 is not involved.

Also the $70 fee is only when DoS processes the case. When USCIS does it there is no fee associated with I-864.

As it turns out, Mark having clarified what he was writing about, he does not need to send "that fee".

His original post was confusing, it's best to develop the habit of clearing up confusing questions before answering them. An especially good habit to have when it comes time for visa and adjustment interviews when improperly answering a mis-understood question can have ugly consequences. In this case the only consequence would have been him paying an unnecessary $70, but I expect that he would regret having taken your advice.
