I got married in may 2012 ( husband is still not here) would I file as married on my taxes?

If you are married on the last day of the year, then you are married for income tax purposes. There's an exception if you have children, whereby you could elect to file as head of household. So it seems you would be filing as married-filing-separately unless make an election to treat your spouse as a resident for tax purposes and follow the steps to do that. Then you could file a "joint" return.

Does your husband have a Social Security Number? .... (Probably not if he is not in usa yet, and usa has not recognized your marrage untill the visa process is completed)

You have the option to deferr your tax's or you could refile your tax's once your husband gets here.

I can still file married though right?

well the thing is if you file married then you will be asked to fill in the social security number of the individual whom you are married to, so if you cant fill out the forms properly it will get rejected (since your husband does not have a social security number) and then you will have to explain why etc. so in short "NO" you can not claim your husband at this time. Additionaly think of it this way, In the tax year you are attempting to clame him for tax benefit would he have been in a position to contribute towards paying tax's? (answer is no.. because he was not in the states, nor is he a legal resident of the US till immigration is complete and he has arrived still within that year)

I'm Not trying to claim him lol I just want to get my taxes done and I'm unsure how I should file them..

File your taxes as single, Once your husband gets to USA and has a social security number you can consult to ammend your tax's from prior year and refile.

Filing as single when you are married would constitute tax fraud. You should absolutely not do this.

If you are married there are only two correct filing statuses: married filing jointly or married filing separately.

In most cases, if your marriage is recognized as legal in the locale it was performed, then it is recognized in the USA. I mean,assuming you're a hetero couple both of the age of majority. Whether you received a visa yet or not doesn't change your marital status.
