My husband just received the I-797 and we're so confused. It first states that the petition indicates that the person for whom he's petitioning for is IN in the USA and not eligible to file for an adjustment of status. But I'm NOT living in the USA. Then it states that I should file form I-824. What gives?? Help! What do we do next? :unsure::help:

Double check your I-130 paperwork. Did you tick the wrong box somewhere by accident to give them the wrong idea? Either way I agree that you need to call them. Good luck!

August 2008 - We met (Both living in Egypt)

October 2008 - Moved in together

Sept. 2010 - Engaged (Living together in Cyprus)

June 2011 - Married!

11 July 2012 - I-130 sent to Chicago Lockbox

20 July 2012 - NOA1 Received (via email)

29 July 2012 - NOA2 Received (I-797)

23 Aug 2012 - NVC Case Number assigned and AOS invoice received (via email)

27 Aug 2012 - AOS bill paid and DS-3032 sent via email

5 Oct 2012 - AOS packet sent

20 Nov 2012 - RFE on AOS packet received

16 Dec 2012 - IV bill paid

25 Jan 2013 - IV packet and AOS RFE response sent

22 Feb 2013 - Case Complete

6 March 2013 - Interview date rec'd

10 April 2013 - Medical Scheduled

12 April 2013 - Interview

01 Oct 2013 - Entered US

Hi Folks,

Just an update on my I130 drama. As I reported previously we received the the I-797 and there seemed to be some confusion on the part of USIS on whether I was living in the USA at this moment (I'm not). Then the letter advised us to file form I-824. I took the advice I got on this forum and my hubby called USIS. Long story short, it turned out to be a "clerical error" on their part, their words, not mine :unsure: The y emailed us that our file was sent to NVC. My hubby called NVC (and actually got through :dance:). Our case has indeed been transferred!!! We should get a case number in a week to 10 days. Thanks everyone :thumbs:

I'm living in Egypt with my wife. I did the I-30 and sent it out to my dad and he then sent it to the phoenix. I got the email today that they accepted the application. I put in the application an extra paper stating I live in Egypt and that if anything needs to be sent out, needs to be sent to Egypt

My question is what are they going to do? Do they send it out to Egypt?
