What happens once I actually file?

So, with all the research I am doing to try and file as soon as possible, the one thing I am yet to know, is what exactly happens once I file? Can anyone help explain the process to me.

I know that obviously once I file, the case has to be looked at in some way, will it automatically be accepted, or is there a chance of it being denied straight away for any reason? Or do all cases have to go through the process?

I understand, that if there are any RFE's, then those will occur.

Once all the info has been received, my documents will be looked over. I'm certain at some point, my wife will be called in to be questioned in regards to my personal statement. Will this be in person?

Once this has occured, who actually makes the decision? Does it happen before a judge?

Just thought I would try and get all the info I can!

AOS Journey

Day 0 - 07/10/2012 - AOS package (I-130,I-485, I-175) mailed to Chicago with FedEx.

Day 1 - 07/11/2012 - Confirmation from FedEx that package arrived and was signed for.

Day 3 - 07/13/2012 - Text confirmation from USCIS of receipt.

Day 4 - 07/14/2012 - Online banking shows that cheques were cashed.

Day 9 - 07/19/2012 - Received 3 out of 3 NOA letters in the post.

Day 11 - 07/21/2012 - Received biometrics appointment letter, appointed set for 08/07/2012.

Day 16 - 07/26/2012 - Completed biometrics walk in.

Day 56 - 09/04/2012 - Received text notification to state that my EAD has been ordered into production.

Day 59 - 09/07/2012 - Received 2nd text notification to state that my EAD has been ordered into production.

Day 62 - 09/10/2012 - Text notification that EAD has been mailed.

Day 64 - 09/12/2012 - EAD received in the mail.

You don't say what you are filing for, but I assume you mean VAWA.

they are not allowed to let your wife even know that you have filed a vawa application - it is confidential and they cannot disclose it to anyone. Your personal statement needs to be in the form of an affidavit, not in person. Once you have filed your i-360, if it has all supporting evidence that is required they will issue a prima facie notice - which does not mean it will eventually be approved, it just means that at first glance you have net the initial requirements. If something is missing then you will get an RFE. Once you send your RFE response back you will get a prima facie. However, there are some people here that never got a prima facie at all. It only really helps if you need public benefits. Cases are not before a judge, instead they are adjudicated by a specially trained 'VAWA unit' in Vermont Hope that helps!

It would be easier if you stick to the VAWA part 3 thread, you would get more responses!

11/02/2012 - Appointment notice issued for i-485 biometrics appointment on 11/27/2012

11/08/2012 - Biometrics notice received and returned with a request to reschedule.

11/15/2012 - i-765 Approved / Notice Mailed / Card Production Ordered

11/19/2012 - EAD Card Mailed / Approval Notice Paper Copy Received

11/23/2012 - EAD Card DELIVERED!11/30/2012 - SSN applied for - card received 7 days later!

12/14/2012 - Biometrics done (walked in a few days before my appointment, was a great experience!)

04/05/2013 - Third Prima Facie Received valid for 60 days

04/11/2013 - Sent additional evidence that was unavailable at time of filing, received by VSC on 4/15/2013.

04/18/2013 - Touched (acknowledgment of correspondence received by USCIS)

04/26/2013 - I360 APPROVED!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

05/02/2013 - Received in mail approval notice (dated 4/24/2013 - a year to the day that i filed!) and notice of deferred action.

06/24/2013 - i-485 Transferred to NBC "to speed up processing"

07/03/2013 - RFE for medical

10/10/2013 - RFE response mailed, a few days late - praying that its still accepted!

10/17/2013 - Case updated to show 'RFE Response Review'... waiting on an interview date now i think!<p>

04/16/2014 - GC INTERVIEW!!!!! Felt it did not go well

05/02/2014 - green card approved!

Oh, Im sorry! I thought it would be easier to keep all separate topics of conversation in separate threads, so that the VAWA thread didn't get too overwhelmed.

I will try and keep everything to one thread. I will post over in the VAWA thread now. If an admin wants to close this one, that would be fine!
