Hello all,

This is my first post here on Visa Journey. I'm basically just looking for a peace of mind on my situation, and to hear from anyone who had a similar situation.

In short, I was lucky enough to meet the most amazing woman I know. I am a US citizen, and she live in Ukraine. We decided to marry in Ukraine last year, and then filled for her Visa.

Today, she had her interview at the US Embassy. At the interview everything went very well for her. However, they did not issue her the Visa. Reason being she did not have my W-2 Tax form from the most recent year. She DID however, have my tax return that I recieved directly from my local IRS office. The person interviewing her would not accept this form, and informed her it needed to be the W-2 form.

There is good news though. They took her passport from her, and made figerprints. They informed her that I just need to e-mail my most recent W-2 and everything will be OK. I know from experience that they place the Visa in her passport, so them keeping this document is a very good sign. I also was able to e-mail the embassy my 2011 W-2 within an hour after she gave me this news.

I called my atrorney and he was confussed why they did this, but it happened and we need to deal with it. I am just curious if I should be worried for any reason, and if this has hapened to anyone, what was there experience. We both have been VERY patient, and was hoping to spend Christmas together. I do not see this happening, but anything anyone can say to put my mind at ease would be great!

hey climber i feel your worries sveta was told approved at kiev also oct 24th and was asked for birth record and was told within 15 days have visa she mailed same day and we had not recieve visa of yet and state department only reply with in ap status aka in reveiw aka on hold even after embassy told sveta on nov 20th that the papers was in mail room for 2 weeks so the 15 days start on this date wish you faster visa in hand then we had

A W-2 copy should be attached to your ITR as far as I know... all of my ITR has a copy of all my employers W-2.

During our interview the guy ahead of us was asked a certain document, he said he can produce it asap and can even come back that afternoon, the officer said very well, just submit that document whenever you want can be today or any day and we will process your visa.

I hope its the same with your case.

Thank you everyone,

I was able to send a scanned copy of my W-2 (front & back) as well as the PDF file directly from my employer. The embassy also responded to my e-mail stating they recieved the papers and are under review.

As I mentioned, they kept my wife's passprt and took her fingerprints. The man was very confident and polite when he mentioned they will approve her Visa about 10 days after recieving my paperowrk. I just hope this is all correct......

We planned on spending the holidays togther this year in the US, I'm guessing that won't happen. It's OK though, I just worry about her SAFE arrival. :)

Did she have your recent tax return, or your recent tax return transcript?

Your lawyer should know that the consulates prefer tax return transcripts. With tax return transcripts, no w2 is required.

Consulates have NO preference when a consulate accepts either, it accepts either. If the form presented is the 1040 form, regardless where it came from, you need to also attach the w-2 forms to it (or 1099's and all schedules) IF the form presented is an official IRS transcript, then you do not have to attach the w-2s. Usually. A consulate can request anything they like in order to satisfy them that the intending immigrant will not be a public charge and THAT should not surprise an attorney.

For the next 4-5 years, make SURE you keep copies or get transcripts, you will be needing them

Thanks. I like your signature. I live in New Hampshire and do a lot of work in Vermont, and YES it is a beautiful place!

Sometimes it says "Vermont...Keep it Weird!" :lol: Being from NH I am sure you would agree with that also. :P

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
