Can you be Reaffirmed and closed by VSC before it's forwarded to Embassy?

Hello All,

Can anyone who has gone through a Reaffirmation please help. I contacted my senator to help move along the Reaffirmed petition back to the Embassy. I was informed that on November 16, 2012 my case was approved or reaffirmed and sent to the State Department. According to the email from the Senator, .........

"The current processing of consular returned I-129F K1 petitions is that the case will be reviewed according to the chronological date it was received back at VSC. If the review determines that there is no service error involved, the I-129F will be administratively closed as the validity dates have expired, and the case will be stored. The petitioner will receive a letter with this information from USCIS which also states that this action does not preclude them from filing another I-129F if he or she chooses to do so.

T his petition was not affirmed and remains pending at this time. VSC is currently working I129F consular returns r eceived on or prior to 1/1/2011."

What are they talking about., I thought I was already reaffirmed????

PLEASE help...do I need to get a lawyer at this time?

I am totally confused now. It seems like they're not sending it back to the Embassy for another interview and that it's going back to USCIS I don't know, Aster. I am sure someone else who is more educated about this will come along and help. I have no idea what's going on. So sorry.

Please state the exact words in the email from the senator that you believe was an reaffirmation. I just send you a PM but something in your post is unclear to me so disregard the PM not to confuse you further.

The above email you received from the senator is a "general, canned " processing answer on how returned petitions are handled.

The only thing I see pertaining to your case from your post is that your case is still pending.

Could you have misunderstood the email your senator received ( general, canned processing answer) as you have been reaffirmed?

I need to know what (exactly which words ) made you believe that you were reaffirmed, because the above shows only a general reply.

I also posted this last week because I wasn't sure if I was reaffirmed. Here it is again, according to the USCIS site,

On November 16, 2012, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly.

Am I not reaffirmed?

Looks like it has not been entered into the system yet. Keep calling dos and nvc. It will go to nvc before the embassy.

I would also wait a week and then contact your embassy for another appointment.

When we were re-affirmed, and this goes back to 2010 so procedural differences may exist, we received a new NOA2. Same 797 form just with a new letter stating the case was re-affirmed [not just "approved"].

Actually, this was back in the "good old days" prior to online updates, text alerts, etc - I literally got a letter in the mail I was NOT expecting [thinking the case would be closed out].

well...it was to good to be true

I just called USCIS again today and spoke to a level 2 Rep. I was told, the entry on the USCIS site was most likely an error because they could not have approved or reaffirmed in such a short time. She will email a request to investigate and get back to me via a letter as to what is the status of my case. oh and by the way, after all this....they will most likely close my case because the validity date has expired. It will be 2 years in March since I started this journey....I am numb, i don't know how to react any more. This up and down is killing me.

Vermont often reaffirms unlike CSC so you still have a bit of hope.

I hear you with this up and down roller coaster mess....am in a similar boat for 2 years.

I hear you....I just checked no email and the status is still the same " approved or reaffirmed". It's tortureeeeeeee
