Hey Guys!

While I was in separation period from my ex-wife that lasts almost a year, I met my current wife and we get married before my divorce from my ex wife was finalized. I talked to a lawyer when I was ready to file i-130 for my current wife and he suggested that I need to remarry her, so the act marriage will be legal and accepted by INS,which I did on May 2012 and than I filed in July 2012. Now, I submitted photos that shows our honey moon in egypt ( july 2010) with the petition application. she get her visa to Egypt for our honeymoon because I was an USC citizen and it is noted on her passport. I did not mention on the I-130 app that I was married to her on July 2010 since I had to remarry her and send the new act of marriage done on May 2012. Would that be a red flag?

This sounds like a recipe for disaster. I surely think you will encounter some concerns/ be prepared

so, you got a list of red flags.

practice writting up a letter of attestation on each red flag, include these letters WITH the I-130 submittal.

I already submitted a I-130 in july 2012. Do you suggest that I sent an attestation letter explaining this issue?

Bigamy, thats a big no-no. Did your July 2010 marriage get annuled? how were you able to re-marry? Is being single not a requirement for marriage there (where did you marry)?

Bigamy, thats a big no-no. Did your July 2010 marriage get annuled? how were you able to re-marry? Is being single not a requirement for marriage there (where did you marry)?

I was married in my home country and I was not asked to submit any proof of being divorced from my ex-wife. Yes, my July 2010 marriage was annuled when I had to remarry my current wife in May 2012. I sent INS the new act of marriage not the old one when I was still not divorced.( got my divorce from my ex on december 20110

if the I-130 is approved, sent those in with the DS-230.

You have LEGALIZED the marriage by remarrying her after the divorce was finalized, so that's a plus.

As stated previously provide the documents that annulled the marriage and as the only one being interviewed is your wife she better be ready to explain the wedding pics dated July 2010 before you divorced, bigamy, the annulment etc,,,

You never claimed the first marriage for the petition so I think you are ok with no misrepresentation..the pics just make for a sticky situation..

I suggest you follow the advice of your lawyer. In my not lawyer opinion, he has advised you well. No need to mention a "wedding" that was not a legal marriage. The forms ask about former marriages. You answered accurately. Your first wedding to your current spouse, did was NEVER a legal "marriage". The questions are about legal marriages, not ceremonies that do NOT result in "marriage".

Be prepared to explain the situation honestly and accurately, if asked. If you are not asked, that's good. Isn't that pretty much what your lawyer told you?

For other readers, marriage to too people at the same time is a crime most places but not all. It depends on where the marriage took place. Polygamous marriages are currently lawful in Egypt for all Muslim men.

I was married in my home country and I was not asked to submit any proof of being divorced from my ex-wife. Yes, my July 2010 marriage was annuled when I had to remarry my current wife in May 2012. I sent INS the new act of marriage not the old one when I was still not divorced.( got my divorce from my ex on december 20110

This seems strange to me and I am surprised that if you got married in Morocco that you did not have to submit divorce papers to get married. When we got married we had to submit my divorce papers and also my husband had to get a document that he was single and free to marry.

I am glad you got the paperwork fixed and in this case I would follow the advise your lawyer gave you. Good Luck!!

thank you. when i married my wife i was under the impression that only a legal separation from my ex is good enough .. but i was wrong as a finalized divorce decree was a must for the new marriage to be legal and recognized in US. however, i had to remarry my current wife to show a post divorse date on the act of narriage that i submitted to USCIS.

That make sense and more than likely Morocco accepted the legal seperation papers as divorce papers and the person reviewing them did not know the difference. I am glad you go it all straightened out!
