Bad Luck! my gf went to the cartorio today and one of the documents was denied! The Power of Attorney, the wording in the document didnt state some things so they requested a new one and is really time consuming going back and forth. So as mentioned before, She could come to USA and we get marry here, is takes just 2-3 days process unlike Brazil 2-3 weeks. BUT HER MAIN CONCERN is VISA FRAUD! obviously is not legal to come and get marry on a tourist visa and over stay. From the answers is k ASLONG as she RETURNS, but what will she tell the immigration officer upon entry? Thats her main concern, she doesnt want to lie to them, she likes to do things right. If she tells them that shes coming to get marry here then how is she allow entry? Please help....this process has been stressful. Also Tricia599 she did ask in the Cartorio if my passport number will show they told her no which now idk if it depends on the cartorio, idk... I was ready to go get a VISA for my USA passport to avoid any headaches in the future. And once again to reiterate while we file for the CR1 she could travel back and forth? I hear mixed answers with this question. Thanks for everything guys.

I have a very confusing situation. I have my gf living in Brazil. She was an apeur for 2 years in USA and thats how we met. We want to be together and decided to pursue the CR1 visa. She has a tourist visa but we decided to get married in Brazil. I find the process very confusing as I was born in Ecuador and I will need to travel to Ecuador or have someone there to take my birth certificate to the embassy of Brazil to get it "consularizado" as well as a copy of my passport. I dont have a visa in my US passport since ill be using my Ecuadorian passport to travel to Brazil. Now theres many questions I have and would like to know if anyone had experienced something similar, I would appreciate all the advice I could get. Since I will get married in Brazil after getting all the right documents, Will it have any conflict when we apply for the VISA CR1, since instead of using my US Passsport (dont feel like paying the $180 fee to get the visa) I will be using my Ecuadorian passport to get marry in Brazil. Will it affect in any way?

Also will it be "legal" instead for her to just use her tourist visa to come here we get married and then within 3 months she will change her status and get her green card, MUCH FASTER PROCESS. Since she already visited, lived here for 2 years, it wouldnt necessary be considered preconceived intention of getting married while she is in her tourist visa?

For her to enter US on a tourist visa with the intentions of getting married and then filing for AOS is considered fraud, and for this reason if she enters and states to the officer she is there to get married she could be denied entry even if she is planning on returning to her country to wait while you file for a spouse visa.

Right I understand that, what if she doesn't mention it? She will go back.do they keep a record of the answers at POE? that will come back and affect us later on?

She can however, enter the US on a tourist visa, get married and return home before her I-94 expires. You can file for CR-1 immediately after your wedding.

I'm gonna be honest, it's extremely hard for me to follow your post but I will tell you this.

Never lie. Neglecting to disclose the truth is lying by omission. Almost ALWAYS has a POE officer asked 'what is the purpose of your visit' Getting married is a purpose. You can't change your status afterwards, she must leave.

Also, my husband entered the US to get married, disclosed it, and was denied when by perfect timing, I called to find out the status and spoke with a supervisor and asked if I had to cancel our wedding.

The supervisor overturned the denial and allowed him in.

Disclosing can also screw you over if you don't get lucky.

All this is is experiences and advice.

I understand she can't lie and she doesn't want to lie. Will she need to proof that she will be going back? Is just a lot easier to get married here. I do have the second option getting married there no problem just need to go and get a power of attorney letter motorized and take it to the consulado and then mail it is about 3 weeks time plus an additional 2-3 weeks to schedule the appointment with the civil court in Brazil

I don't get how CR1's are even available since it is fraud to go and marry a partner in any circumstance :/ it seems no matter what way either person enters a any country your not supposed to marry while there :S How is anyone supposed to marry while staying within the law to be able to apply for the CR1?!?!?

No one said it's fraud to marry in the US.

It's technically lying if you don't disclose during entrance when they ask what your intentions for entrance are. My husband gave his intentions. His original denial was probably due to a lack of ties or a history of the POE officers being jerks to him (to put it bluntly).

No I didn't mean it is fraud to marry, but on all visa's needed to marry in the usa or other countries all seem to state that you can't marry on them. There must be one which allows you too?!?!? Like when I went to usa I entered via the vwp and I am sure one of the clauses on that was I must not marry while in the US using that kind of paperwork to enter the country.

It makes it understandable why so many people don't want to disclose it.

US to canada doesn't require a visa so I have no fine print to follow.

It seems ridiculously hard to get a toursit visa in brazil unless you have a job that pays well, house, going to school, car, etc. Just warning you, If you decide to go this route there's a really good chance she will be denied if you don't have all the strong ties.

Actually my gf already has a tourist visa! SHE was pretty lucky! got it in just 1 Month or before that. Just will like to know if someone has entered the country with the intention to get marry here and what exactly was done at the POE? Will she need some documents to proof? Is it recommended? wouldnt want to be denied and spent all that money on the plane ticket.

Come to Canada and get married! We let people come in and get married then leave. My husband said "I'm getting married" the officer said "congrats!". Lol :-). You can also go to resorts in Hawaii or Mexico and get married too! I think the point is to show she is returning to her home country with a return ticket, etc and if they ask, she can show proof of residency in Brazil.

Right, I have read that, as long as you have proof, and intent to go back it should be enough.

you are asking people on this site how to help you lie and get around the reason for the true visit to the US. I do not understand why this thread has not been closed as you are asking how to commit immigration fraud.
