Hi everyone!! I'm new here... and I want to share with you my coming experience:

I met my fiance in Venezuela, he was working here for a couple of years, but I met him 5 months before he was ending his project here, i visited him twice this year (US), and I'm visiting him on January 1st for 2 weeks, travelling with my daugther this time. He has no idea how to file for K1 visa, even that I showed him this website, and uscis website, but still he said is so confusing, he wanted to hire a lawyer, but i think it's insane to pay somebody $4500 for this paperwork, so i decided to work on the paperwork together when I get to the US, and add some new pictures of us (we already have a lots of pictures), but anyway i think it's a good idea. Now, i'm kind of nervous, because I know there is a guide to follow,but my big question is, should we send the first package while i am there? and write on the I-129 form that i am there? Or is it better to leave the country and then my fiance will send the package?

Thanks in advanced for your help, and please if you have tips on how to build the first package to send...let me know!

if you will be visiting US, you have option to marry and then do adjustment of status.

That isn't an option. That's fraud!

If you visit on a B2 or VWP with the intention to marry and adjust status that is fraud and you will probably be denied.

Follow the K1 route using this site as a guide and you will do fine.

We are starting our petition around the same time whilst I am visiting my fiancé in the US.

You are perfectly fine to start the K1 process whilst there.

Just ensure you don't overstay!

04 - 2012 - Spent 10 Days in SC - Engaged

08 - 2012 - Amber visited UK for 16 days.

We filed our approved I-129F when my then fiancé was in America. It wasn't a problem and there is a space on the form to put the information in. If anything, it adds to the evidence that you've met and your relationship is real. You'll also want to include copies of boarding passes and stamps in passports as proof of travel dates.

You could marry in the States, and then go back to your country and file for the CR1 visa.

If you chose the K1 route, your fiance has to petition for you, so he will be sending the I129f form etc (he can do this while you are still in the States).

You will also have to file for your daughter.

Honestly, my fiance was telling to get marry there, and stay with him, and then change of status, he thinks is crazy to be apart during the long procces of the K1 visa, but i have learned through this website that legal way is k1 visa, right or not?? I know him, and he will start with the same idea as soon as I get there.

If you come to the states on a visitor visa with the intention of getting married and adjust status, that, constitutes immigration fraud. On the other hand, if you are here and while here you get married and change your mind and decide to stay and, apply for adjustment of status does not, but, when the time comes for an interview in front of a federal officer, you will be hard pressed to demonstrate that your original intent was not to use your visa to side step correct (and legal) procedure.

A K-1 visa, is a visa that allows the fiance(e) of a USC to come to the country and get married (within 90 days of arrival) and adjust status.There are a few more options for you. with pros and cons, check the following link it may help you on your decision
